Relying on Illegal Policy, City Refuses to Fax "Evidence" of Its Supposed Timely Filing of July-September Reports on Sewage Plant in Lincolnville

My dear Mr. Regan:
1. When did the City Commission adopt this "policy?"
2. My information is that it was never adopted by City Commissioners.
3. My information it is not part of the City's ordinance.
4. The policy is illegal and thus remediable in federal court. 42 U.S.C. 1983, 1985, 1988.
5. You could have faxed me the requested cards on December 31.
6. You did not do so.
7. Now you emit bureaucratic flippancies -- either you filed timely or you didn't (you do not answer my questions).
8. You either have the cards or not.
9. Again, kindly fax me the cards like a normal person would do, instead of demanding 15 cents per page of copies I don't need.
10 I am sure that Allison Ratkovic can fax it quicker than she can write or send more officious E-mails (below).

p.m. and consider your request a public records request made pursuant to Section
119.011, et seq., Florida Statutes.
We understand your request to include return receipt delivery cards for
receipt of the reports for Quarter 12 of the Three Year Compliance Status Report
for the City's wastewater treatment plant and any documents associated with
reports filed. The City's Public Records Policy provides that copies of public
records are available for a statutory fee of $0.15 per page.The return receipts
total three pages, and the associated documents total an additional 48 pages. At
$0.15 per page, copying costs total $7.65. You may review the records or obtain
copies at the Office of the City Manager, 75 King Street, Fourth Floor, St.
Augustine. Copying fees are payable at the time the copies are obtained.
Please advise us as to how you wish to proceed. Thank you.

Dear Mr. Slavin,
Your email corespondence dated 12/30/08 at 4:39 p.m. has been referred to our
ffice for response. City staff have investigated the entry on the EPA ECHO
hree Year Compliance Status by Quarter Report for the City's water and waste
ater treatment plant showing a failure to file the DMR report for quarter 12 of
he three year compliance period.
The investigation reveals that the City submitted the DMR's in question and
ossesses certified mail receipts signed by the agency showing receipt of the
eports. In addition, the Florida Department of Environmental Protection's
ompliance representative, Karen Girard, concurs that the DMR's are on file and
ould offer no explanation wh
y the ECHO website indicates a reporting violation.
s. Girard further indicated that she will investigate the apparent error and
ave the website corrected by next month.
In summary, any error appears to lie with the EPA website and not with the City
f St. Augustine.
