Dear Sheriff Shoar:
Happy Easter and Happy Passover.
1. You will kindly recall that, in May 2009, your secretary made an appointment with me to discuss MICHAEL GOLD's hate websites. You canceled the meeting abruptly, based upon some urgency. You did not reschedule it. Why? Shortly thereafter, you saw me as you entered the Publix grocery on Anastasia Island. You abruptly left the store. Canceling meetings and avoiding speaking will not solve the problem.
2. Tortfeasor MICHAEL GOLD is persisting in his libel, slander, defamation, obscenity, indecency and false light invasion of privacy. It is reflecting upon you. GOLD started his hate website for the express purpose of running homeless people out of town, as stated in his December 23, 2006 column in the Record. GOLD has since attacked African-Americans, women, Gays and political activists. GOLD uses various front-names (NICs) and is joined in his animadversions by public officials, sometimes posting under their own names and sometimes under NICs. We know who they are and so do you. You have been briefed on the situation and cannot claim "plausible deniability."
3. As Edmund Burke said, "all that is necessary for the triumph of evil is for good people to do nothing." Are MICHAEL GOLD's actions now attributable to you and your organization, since you have not renounced them? Gold was your campaign manager and you are his mentor. He claims to speak for you, uses inside information from the SJCSO and is widely regarded as the "hatchetman" for the political machine that controls our County and our City.
4. GOLD's latest temper tantrum tactic is to display photographs of me and associate them with a fictitous character, "Ed McCarthy," perhaps giving some people the false impression that I would post on a racist, sexist, misogynist, homophobic website. This misuse of my likeness violotes Florida law, ande is actionable.
5. If you ignore this E-mail, as you have ignored complaints from others in our community, you will have ratified GOLD's behavior. You will have ratified the two hate websites.
6. Pursuant to the Open Records Act, will you please E-mail me all documents, including E-mails, involving in any way MICHAEL GOLD f/k/a "MICHAEL TOBIN and the hate websites www.plazabum.com and www.shamefulpeople.com?
7. By copy of this E-mail, I am asking the Asplunds to please place on the agenda of a future Marketplace meeting the implications for Believers if they routinely practice lashon hora?
8; MICHAEL GOLD (who raised more than $250,000 for you in 2004) appears to be the primary practitioner of lashon hora in our town, acting for the benefit of your political machine, Among other overt acts of lashon hora were GOLD's hate postings about a local woman suffering from cancer, expressing the hope that she would die a horrible, painful death.
9. In the light of wisdom and experience, and in the spirit of Easter and Passover, I am sure that you will want to speak with GOLD about his sins, crimes and torts. Thank you in advance for your engaging MICHAEL GOLD in moral reasoning.
10. Failing that, will you be held by a Court to have "ratified" the contents of the two hate sites run by your erstwhile campaign manager?
11. In the event that a Court finds that you and SJCSO gave MICHAEL GOLD and other persons "significant encouragement, covertly or overtly" a federal court jury could find you and SJCSO corporately and individually liable for civil rights violations. Blum v. Yaretsky, 457 U.S. 994, 1004 (1982). If you and your office are found by a Court and Jury in a civil rights action to be responsible to pay compensatory damages as a result of GOLD's actions, does your office's or your personal insurance policy entitle you to indemnification?
12. Does your office's insurance cover punitive damages?
13. Will a Court of competent jurisdiction find that obscenity, indecency, racism, sexism, misogyny, homophobia, hatred of the homeless and attacking activists is not within the "business of the named insured" (SJCSO and SJC)?
14. Will the insurance company file a declaratory judgment and deny you coverage, leaving you personally liable for the torts of MICHAEL GOLD as your agent and alter ego?
15. What do you reckon?
