Dear Mr. Regan, et al.:
1. Responding today by replacing the wrongfully removed 60 chairs -- and by removing the five (5) or six (6) superfluous large institutional cafeteria-style tables at the rear of the City Commission room -- will avoid the need for anyone to file any criminal and civil complaints of violations of First, Ninth and Fourteenth Amendment rights under 18 U.S.C. 241 and 243 and 42 U.S.C. 1983 and 1985 or any complaints against professional licenses, including Mr. Regan's P.E. license.
2. Please respond by stating that the 60 chairs wrongfully removed by your predecessor will be replaced and the staff tables will be removed.
3. I have been ready and willing to meet with you since your abrupt cancellation of our scheduled meeting more than five (5) months ago.
4. Our City of St. Augustine persists in a routine pattern and practice of First Amendment violations -- including routine violations of the rights of artists and musicians and refusal to allow public comment on every single agenda item, as is the practice at the City of St. Augustine Beach, St. Johns County Board of Commissioners, Anastasia Mosquito Control District of St. Johns County, and other local governments.
5. This lawbreaking is now the subject of yet another federal court case, which our City of St. Augustine will lose, once again.
6. There are unresolved issues concerning Americans with Disabilities Act (ADA) violations -- cruel refusal to restore the 60 chairs for Mayoral inauguration seating.

There are also new questions concerning reported insensitivity and lack of planned ADA reasonable accommodations at our "Celebrate 450!" entertainment nights -- questions raised by Ms. Heather Neville's heartless statements on Facebook about how the disabled should pay someone to push their wheelchairs across the Bridge of Lions for "Celebrate 450!" Ms. Neville, spouse of City Commissioner Todd Neville, has since removed her statements from Facebook, but despite this attempted spoliation of evidence, the statements have been provided to disability rights lawyers and they may be read here: http://cleanupcityofstaugustine.blogspot.com/2015/07/let-disabled-pay-to-get-pushed.html No documents have been provided yet in response to my Open Records requests Nos. 2015-244 and 2015-246 (only an illegal SAPD fatwa demand to pay for a simple IT search for Ms. Neville's e-mails). Does Ms. Neville speak for our City? Will Ms. Neville ever apologize to the people she insulted on Facebook? Does being the City of St. Augustine "mean never having to say you're sorry?"
8. If there is no change in the City's behavior, do you expect other consequences, including potential picketing and complaints against professional licenses?
9. Does our City's misanthropic misbehavior invite picketing during the 450th and the visit of the King and Queen of Spain in September?
10. Our City's continuing lawbreaking promises to create yet another international incident, like the one that the unethical man whom you publicly call your "mentor," WILLIAM B. HARRISS, created in 2001 with his arrogant insults directed at ACLU protests, which flummery dirtied our City's reputation in the eyes of the entire world.
11. During their Royal visit in September, will the Spanish King and Queen ask Mayor Nancy Shaver, et al. about our City's behavior again embarrassing the Spanish government, whose Spanish Constitution Monument graces our Slave Market Square? The City of St. Augustine's hostile, offensive actions are an embarrassment to free people everywhere, including our Spanish visitors. The removal of the 60 chairs is a synecdoche, neatly symbolic of the mendacious manipulations of the man whom your director colleagues long admiringly called "The Minister of Propaganda," City Manager John Patrick Regan, P.E.
12. Our City's actions violate the U.S. Constitution, but they would also violate the Spanish Constitution.
13 As we near our 450th, the whole world will be watching you and the government of our City of St. Augustine, and City Manager John Regan, P.E.
14. Please govern yourselves accordingly.

Dear Mr. Regan, et al.:
1. Please replace the 60 chairs in our City Commission meeting room that were removed by your "mentor," former City Manager WILLIAM B. HARRISS circa 2007-8
2. This removal violates ADA and continues to do so, forcing people outside in the courtyard subjected to rain and heat and cold when major issues are discussed.
3. I have already filed a complaint with DOJ re: your reprehensible refusal to provide enough chairs for Mayor Shaver's inauguration, despite a month of promises.
4. You previously promised to take action on this. Many people are expected to attend the 7/27 and later City Commission meetings re: DOW PUD.
5. Please remove the unnecessary staff tables introduced as a ruse to discourage public participation and make citizens uncomfortable in our own City Hall.
6. Failure to provide adequate chairs for the next and successive City Commission meetings will have consequences.
7. Any such failure may subject you and your staff to further liability.
8. Concerned citizens may file complaints against professional licenses, including your State of Florida P.E. license, if you do not replace the 60 chairs and cease and desist obstructionism to the public's right to attend City Commission meetings and participate in our government and obtain government records.
9. Please govern yourself accordingly.

ReplyDeleteFire code permits restoring chairs after tables are removed. Tables were added to reduce the number of seats for citizens. I have never seen any of the city staff offer a seat to a senior, or a disabled person. But DAVID BIRCHIM allowed DAVID BARTON CORNEAL and mouthpiece ELLEN AVERY-SMITH to sit in the fancy-bears chairs. The tables and chairs at the back of the room are unnecessary privileges for people who don't require them: they prevent chairs from being restored. We see right through City Hall's tactics.
ReplyDeleteReminiscent of the last authoritarian Alabama Governor GEORGE CORLEY WALLACE standing in the schoolhouse door, first St. Augustine City Manager WILLIAM BARRY HARRISS, and now City Manager JOHN PATRICK REGAN, P.E., practice Jim Crow law with their obnoxious "disappearing chair act." As Bill Clinton said,, "Nothing great was ever accomplished by being small."
