Dear Commander Parker and Chief Hardwick:
1. Thank you for your prompt, candid response to my request No. 2016-427.
2. Mr. Tom Reynolds' attorney, Mr. Tom Cushman, has requested that the court reporter provide a typed transcript of the hearing that was held this morning before the Honorable Circuit Court Judge Howard McMillan.
3. Mayor Richard O'Brien was present before the Court when Judge McMillan orally modified his order -- do not let Mayor O'Brien play stupid with you and demand you take illegal actions again.
4. Please do not let Mayor Rich O'Brien induce or euchre you into violating Mr. Reynolds' First Amendment rights any longer.
5. Mayor O'Brien has repeatedly abused your trust and the public trust.
6. Mayor O'Brien does not appear to have any hearing problems or any cognitive problems. At the front of the courtroom, in front of Judge Howard McMillan, Mayor O'Brien heard this morning what Judge McMillan ordered about Mr. Reynolds' right to come to City Hall, to speak at public meetings, to campaign, to walk or ride by Mr. O'Brien's business.
7. Yet Mayor O'Brien maliciously called SABPD on Mr. Reynolds this morning, possibly making a false police report, F.S. 837.05, when Judge Howard McMillan clearly vindicated Mr. Reynolds' rights to be at City Hall.
8. Mayor O'Brien's calling the police on First Amendment protected activity was also possible violation of the First, Ninth and Fourteenth Amendments remediable under 42 U.S.C. 1983. His calling the SABPD was retaliation for protected activity and a civil rights violation and should not be tolerated.
9. Mayor O'Brien heard what Judge McMillan said -- there was no ambiguity in what Judge McMillan said about Mr. Reynolds' First Amendment rights at City Hall.
10. Mayor O'Brien, like Commissioner Samuels and the City, has a custom, usage, practice and procedure of acting under color of law to violate citizens' First Amendment rights. Mayor O'Brien owes Mr. Reynolds a public apology
11. Mayor O'Brien's overt acts may be construed as official oppression and a violation of federal civil rights statutes, both civil and criminal. Mayor O'Brien has hired a developer lawyer who formerly represented the City of St. Augustine Beach and provided malfeasant legal advice, 2009-2016.
10. As an American concerned about continuing assaults on civil and constitutional rights here, I am requesting that you investigate Mayor O'Brien for making a false police report. F.S. 837.05 (third degree felony).
11. I am also sending this e-mail to the FBI and requesting that Mayor O'Brien, the St. Johns Law Group and the City of St. Augustine Beach be investigated.
12. I am also sending this e-mail to St. Augustine Beach City Attorney James Patrick Wilson, Esq. in hopes that he provides guidance to prevent any further possible civil rights violations by the City of St. Augustine Beach.

Ed,
As you were present when I spoke to Tom Reynolds, much of that conversation you are aware of. There are no reports or photos. Any video would be the four of us (me, you, Tom and his son) in the lobby. There is no sound recording of this.
I have not spoken to the Judge or his Judicial Assistant but I have received a copy of the continued injunction. I did speak to Tom Cushman (over Tom’s phone in the lobby) asking him about any additional provisions to the injunction. He mentioned, as Tom did, that the Judge said he could attend city business, commission meeting and exercise his 1st Amendment rights. He did not have an amended copy which is why I had the Clerk’s Office send me what they had (attached).
I have not spoken to Judge McGillan, his JA or Robert Samuels. I did receive a call from Mayor O’Brien advising that Tom Reynolds was in the parking lot, possibly in violation of the injunction. I only briefly talked to Andrea Samuels as she was leaving but nothing concerning Tom Reynolds. I called Tom and updated him that the injunction extension did not mention any amendments as described and is in force as originally issued. He understood and thanked me. Please forward this to Tom as well. Thank you.
