ANDREA SHELDON Gunned Down By Sheriff's Deputies, No Jury Trial Allowed, Appeal Likely


On April 12, 2012, beloved local hospice nurse was shot to death by St. Johns County Sheriff's Deputies.  
1. The crime took place on her front porch.  
2. Deputies snuck up on her home and may have lied about what happened.  
3. Sheriff SHOAR refuses to provide body cameras, but we have audio recordings of what happened, and it appears this death was preventable, with better training and management.
4. There was NO grand jury investigation. 
5. There was only a coverup by St. Johns County Sheriff DAVID SHOAR and the Florida Department of Law Enforcement.
6. On behalf of her estate, Ms. Andrea Sheldon's widower, retired paramedic Richard Sheldon, filed in 2016 a federal civil rights lawsuit against Sheriff DAVID SHOAR and Deputies THOMAS CAMERON COWARD, SCOTT STOKES, GLENN LAPPE, JEREMY HUDDLESTON, MICHAEL R. WILLIAMS and TONY MATEUS.
7. On September 11, 2018, that lawsuit was ordered dismissed by U.S. District Court Judge Brian J. Davis, on summary judgment.   He based the decision on federal civil rights precedents on the 1871 Civil Rights Act, 42 U.S.C. 1983, including an expansive reading of the doctrine of qualified immunity, claiming it protected all but the incompetent or willful violators of Fourth Amendment rights.  Judge Davis held that the fact that deputies "did not announce their presence" somehow "does not change" the outcome, even though defendants had her contact information and could have called her.  The judge held that there was no constitutional violation, while ignoring the fact Ms. Sheldon was in bed when officers approached, and they knew it. 
8. NO witnesses testified live in federal court.  
9. NO jury trial was allowed.
10. Basis of decision: piles of paperwork, with a cursory order written by the Judge and his law clerks.  This judge is capable of better work, as in his March 30, 2018 (Good Friday/Passover) in his rejecting the retaliatory lawsuit brought by Deputy Jeremy Banks against FDLE Agent Rusty Ray Rodgers over the investigation of the September 2, 2010 Michelle O'Connell homicide).
11. Meanwhile, Sheriff DAVID SHOAR's hired guns and henchmen have allegedly indirectly made threats against Mr. Sheldon, attempting to chill, coerce and restrain his right to appeal and speak out against injustice.
12. Our sacred Seventh Amendment right to jury trial was intended as a "bulwark against oppression," as future Chief Justice William Rehnquist said it best.   As Rev. Dr. Martin Luther King, Jr. wrote, "justice too long delayed is justice denied." ("Letter from Birmingham Jail", smuggled out of jail in 1963, ascribing it to a "distinguished jurist of yesterday").

Why this matters:  As Kansas Republican Congressman David Perley Lowe said in enacting the 1871 Civil Rights Act, a/k/a "Ku Klux Klan Act":
 "While murder is stalking abroad in disguise, while whippings and lynchings and banishments have been visited upon unoffending American citizens, the local administrations have been found inadequate or unwilling to apply the proper corrective. Combinations, darker than the night [which] hides them, conspiracies, wicked as the worst felons could devise, have gone unwhipped of justice. Immunity is given to crime, and the records of the public tribunals are searched in vain for any evidence of effective redress." Monroe v. Pape, 365 U.S. 167, 175 (1961), quoting Cong. Globe, 42nd Cong., 1st Sess., App. 166-167.

Prediction:  Justice will be done, though the heavens fall.  A motion to reconsider may be filed, and then appeal of the judge's dismissal order is indicated, along with a federal criminal, civil and administrative investigation of Sheriff SHOAR.
