In a ringing endorsement of First Amendment values, the Florida Election Commission on October 8, 2018 rejected St. Augustine Beach Mayor UNDINE CELESTE PAWLOWSKI GEORGE's legally insufficient September 11, 2018 complaint against government watchdog Tom Reynolds.
The ruling by FEC General Counsel Eric M. Lipman cited the Supreme Court's landmark decision in New York Times v. Sullivan, 376 U.S. 254 (1964), which noted America's "profound national commitment to the principle that debate on public issues should be uninhibited, robust, and wide-open, and that it may well include vehement, caustic, and sometimes unpleasantly sharp attacks on government and public officials. See Terminiello v. Chicago, 337 U. S. 1, 337 U. S. 4; De Jonge v. Oregon, 299 U. S. 353.
The ruling found the Mr. Reynolds made "caustic or sharp attacks" that were "name-calling," but sufficiently grounded in fact or speculation in fact so as not to be false or made with actual malice or reckless disregard of the truth. Any response by St. Augustine Beach Mayor UNDINE GEORGE must be sworn under oath in an affidavit and provided by October 22, 2018.
If no response, the case will be dismissed.
Mayor GEORGE is stonewalling Open Records requests.
Now she says there are no documents in response to my requests for her:
o constitutional law research,
o published articles,
o law school transcript, and
o other indicia of bona fides.
This louche lawyer, filed a 79-page rambling complaint September 11th against Reynolds, a local government watchdogwho at the time was running against her for City Commissioner. Mr. Reynolds withdrew after receiving the complaint, filing a lengthy pro se response.
The last three mayors of St. Augustine Beach -- Mayor GEORGE, Mayor RICHARD BURTT O'BRIEN and Mayor ANDREA SAMUELS --- all have contempt for democracy. Call them the "Devil's Trinangle." Three registered Republican lugubrious goobers with contempt for the law.

RICHARD O"BRIEN lost in his SLAPP stalking complaint before Circuit Court Howard O. McGillin on December 7, 2016. Judge McGillin rejected O'BRIEN's claims he felt threatened by Mr. Reynolds passionate e-mail suggesting that O'BRIEN and his hotelier-running wife "burn in Hell," askiing, "Did you think Mr. Reynolds was the Deity?"
GEORGE has been roundly rejected by FEC -- she can't even write a coherent complaint.

But FEC gave her fourteen days to respond to its two page October 8, 2018 letter.
"Drop the oyster and leave the wharf," as my grandmother would say.
Three cheers for Florida Elections Commission General Counsel Eric M. Lipton, who on October 8, 2018 denied St. Augustine Beach Mayor UNDINDE GEORGE as legally insufficient.
