Tom McFarland, Esq.
Tom is an attorney & Partner at Attorneys Justin Clark & Associates, where he concentrates his practice primarily on probate, personal injury, criminal, and family law.
Prior to joining the firm, Mr. McFarland was a litigation attorney for his own legal practice, commercial litigation, civil litigation, criminal defense and family law matters.
Probate:
Tom has drafted hundreds of wills and deeds. Handled will contests and cases related to conservatorships and powers of attorney. Litigated all issues related to the probate process. Tom can take you through the probate process from start to finish.
Litigation & Appeals:
Tom has argued numerous cases against large firms, insurance companies, and governmental entities. He has drafted pleadings, prepared and argued motions, and conducted depositions for discovery, which included expert witnesses, prepared appellate briefs, responses, motions, and pleadings. Along with handling more than 14 cases in the state Court of Appeals and state Supreme Court with several reported cases.
Mediation:
Tom has gained extensive experience mediating cases involving substantial sums of money and assets.
Corporate Law:
Tom has created corporations, LLCs, and partnerships and represented business entities in litigation. He has handled a variety of cases involving business formation and dissolution and ownership rights of shareholders. Prepared articles of incorporation, bylaws, and all documents related to corporations.
Employment Law:
Tom has handled all employment issues, including several cases before the EEOC and Tennessee Human Rights Commission regarding workplace discrimination.
Family Law:
Tom handled thousands of cases in Circuit, Chancery, General Sessions, and Juvenile Courts. Litigated all issues relating to divorce, custody, alimony, and property division. Represented clients in domestic cases before the state Court of Appeals. Served as member of Child Abuse Review Team affiliated with the Department of Children Services which was created to aid and protect abused children.
Criminal Law:
Tom has leveraged previous experience as Assistant Public Defender in managing thousands of criminal cases in General Sessions and Criminal Courts. Cases ranged from misdemeanors to serious felony cases. He has tried criminal cases before juries. Tom has the experience to not only protect your rights but to fight for the best possible outcome of your case.
Personal Injury:
Successfully represented plaintiffs and defendants in personal injury cases covering automobile injury cases, slip and fall cases, and cases related to owners and occupiers of land.
Ethics:
Taught several CLE classes for attorneys, ranging from Ethics to Ouster Law.
