RULE 4-1.6 CONFIDENTIALITY OF INFORMATION

(a)    Consent Required to Reveal Information.  A lawyer must not reveal information relating to a client’s representation except as stated in subdivisions (b), (c), and (d), unless the client gives informed consent. 

(b)  When Lawyer Must Reveal Information.  A lawyer must reveal confidential information to the extent the lawyer reasonably believes necessary to: 

(1)  prevent a client from committing a crime; or

(2)  prevent death or substantial bodily harm.

(c)  When Lawyer May Reveal Information.  A lawyer may reveal confidential information to the extent the lawyer reasonably believes necessary to:

(1)  serve the client’s interest unless it is information the client specifically requires not to be disclosed;

(2)  establish a claim or defense on the lawyer’s behalf in a controversy between the lawyer and client;

(3)  establish a defense to a criminal charge or civil claim against the lawyer based on conduct in which the client was involved;

(4)  respond to allegations in any proceeding concerning the lawyer’s representation of the client;

(5)  comply with the Rules Regulating The Florida Bar; 

(6)  detect and resolve conflicts of interest between lawyers in different firms arising from the lawyer’s change of employment or from changes in the composition or ownership of a firm, but only if the revealed information would not compromise the attorney-client privilege or otherwise prejudice the client; or

(7)  respond to specific allegations published via the internet by a former client (e.g. a negative online review) that the lawyer has engaged in criminal conduct punishable by law.

 

A lawyer has a duty to keep client information confidential under Rule Reg. Fla. Bar 4-1.6. Subject to certain limited exceptions, all information “relating to a client’s representation” is confidential. Under Rule 4-1.6, even the client’s identity and publicly available information (such as public court filings or internet data) are treated as confidential if they relate to the representation. Anthony P. Guettler and R. Lee McElroy IV, Ethics in Estate Administration – Tips and Practice Pointers, 99 Florida Bar Journal No. 4, Pg 46 (2025) (emphasis added).

The Rev. Dr. Martin Luther King, Jr. stated that St. Augustine and St. Johns County, Florida were "the most lawless" place in America in 1964.

 

The Rule of Law still requires active measures in the wake of two (St. Johns County Commissioners and one St. Augustine Beach City Commissioner involved in 2024 election fraud scheme involving tens of thousands of phony 

 

1. Would you please be so kind as to send me PDFs this week of:

A. the EEO-1, EEO-2, EEO-3, EEO-4, EEO-5, and EEO-6 reports or EEO Data Reports); the complaints, investigations,  correspondence and other documents on USDOL OIG and OFCCP compliance activities involving BAYVIEW and LILAC AT BAYVIEW; the abrupt, cruel elimination of 401K plans and other employee benefits under private equity ownership since July 20, 2021; and any and all USDOL Office of Inspector General investigations pursuant to RICO, the False Claims Act, Medicare and Medicaid fraud, elder financial abuse, retaliation, age, disability, race, gender and sexual orientation and gender identity or other discrimination investigations of BAYVIEW, now LILAC AT BAYVIEW, 161 Marine Street, St. Augustine, Florida, and all subsidiaries, subcontractors or related entities for food service, maintenance, housekeeping, lobbying or legal services.  

 

2. Please provide USDOL and OFCCP analysis and copies of the EEO-1, EEO-2, EEO-3, EEO-4, EEO-5, and EEO-6 reports or EEO Data Reports),  for our  ST. JOHNS COUNTY BOARD OF COUNTY COMMISSIONERS, 500 Sebastian View, St. Augustine, Florida.

 

3. Please provide me with the contact information for OIG, OFCCP and Solicitor of Labor offices and managers with territorial and subject jurisdiction over St. Johns County and other government contractors and subcontractors at this location

 

4. Kindly ask our USDOL OIG and OFCCP investigator(s) and USDOL Solicitor's office attorney(s), supervisors and managers involved or assigned, to contact me to arrange for me to give DOL OIG OFCCP and SOL a signed sworn statement in support of OFCCP's efforts.  I am one of the patient and resident victims of this government, which our SJC BoCC improvidently voted 5-0 be gobbled up by insouciant private equity ownership by July 20, 2021, ending the non-profit local group's decades of zealous Skilled Nursing Facility work for our community.

 

5. Please telephone me this week to acknowledge receipt of this FOIA request.
