Eleventh Circuit Grants Immunity to Officer Who Shot Child Lying on the Ground. (Cato Institute)

Cato Institute has it right on this one.

Qualified immunity for law enforcement officers has been overextended, as here, where our Eleventh Circuit Court of Appeals voted 2-1 to uphold the shooting of a ten year old boy lying on the ground as a redneck peckerwood South Georgia deputy shot at his dog.

This case required a trial, as the trial judge held, not summary dismissal on appeal of a denial of a motion to dismiss.
