Ed Slavin 2015 fraud complaint against AMAZON PRIME



Our maladroit former Florida State Attorney General, PAMELA JO BONDI, is now U.S. Attorney General. With some 1200 full-time equivalent employees, BONDI did nothing to help Florida victims of fraud. Ten years later, the Federal Trade Commission has reached a settlement with AMAZON on its pervasive AMAZON PRIME fraud.

1. On November 24, 2015, Amazon.com, Inc. made false entries in its books and accounts, in possible violation of Florida's Deceptive and Unfair Trade Practices Act (FDUTPA), Section 5 of the Federal Trade Commission Act of 1914 and the Sarbanes-Oxley Act, charging me $101.13 for "Amazon Prime" service that I had not authorized.
2. Since November 24, 2015, Amazon.com, Inc has failed to explain or remedy its fraudfeasing actions, which caused a panic attack and near hospitalization, causing my account to be overdrawn on the eve of Thanksgiving as the direct and proximate result of an illegal and unauthorized $101.13 charge by Amazon.com, Inc.
3. Amazon.com, Inc. Associate General Counsel, Litigation & Regulatory Jeffrey A. Goldberg (whose direct dial telephone is 917-373-9308) has broken his company's December 9, 2015 oral promise to investigate, explain and propose a remedy.  
4. Mr. Goldberg was until 2015 Deputy Chief of the Justice Department Criminal Division Fraud Section in Washington, D.C., overseeing prosecutions of fraudfeasors, including cases brought under the Foreign Corrupt Practices Act, health care fraud and securities fraud.
5. Mr. Goldberg and I spoke by telephone on December 9, 2015, after I left several telephone messages for Amazon.com, Inc. VP, Secretary and General Counsel David Zapolsky (whose direct dial telephone number is 206-266-1323).
6. Bank of America call center operators in Phoenix explained that Amazon.com, Inc. frequently charges customers for "Amazon Prime" service they had not authorized, and that this accounts for 90% of complaints to BoA about Amazon.
7. Please initiate a civil, criminal and administrative investigation of Amazon.com, Inc for consumer fraud and bring an action on behalf of Florida consumers in concert with other Attorneys General. 
8. Amazon's louche and lackadaisical response to my FDUTPA, FTC Act and Sarbanes-Oxley concerns included:
A. its Costa Rican call center refusing to expedite or escalate my concerns on November 24, 2015, 
B. its leaving messages without callback numbers or surnames, 
C. its lawyer breaking his word to investigate and report back to me.
9. Please investigate the frequency and manner in which Amazon.com engages in making unauthorized charges in violation of state and federal laws.  Amazon.com criminal defense attorney Jeffrey Goldberg was placed on notice on December 9, 2015 of the potential consumer fraud and Sarbanes-Oxley problem and refused to report back to me on any investigation or proposed resolution.  Is there an ongoing coverup? 
10. Amazon's criminal defense lawyer's inartful response earlier today (at 1:07 AM) was an admission by silence and adoptive admission by former Justice Department Criminal Division Fraud Section Deputy Chief Jeffrey Goldberg, inter alia stating as follows:
