'He's doing everything right,' defense lawyer says
The US Immigration and Custom Enforcement [ICE] agent arrested this summer in the Florida Keys on suspicion of driving drunk with his two kids in his truck is getting substance abuse help, according to his attorney.
Scott Thomas Deiseroth, 42, of Miami, was charged with misdemeanor DUI, after his blood-alcohol level came back as .17, according to the arrest report.
That’s more than twice the legal limit.
Now, Deiseroth is awaiting trial for two misdemeanor charges: DUI with children in the car and resisting without violence.
“He’s doing everything right,” his attorney Michael Catalano told me Friday. “He’s cooperating, going to counseling and therapy.”
Deiseroth volunteered to use a Soberlink portable breath device three times a day “to show that he is not drinking,” Catalano wrote in a Sept. 3 filing in Monroe County Courts.
The Soberlink contract is for four months.
Deiseroth’s employer, ICE, is keeping tabs on him, too.
“ICE has not terminated him but is expecting alcohol treatment,” the motion reads.
Deiseroth remains on administrative duty and isn’t “presently carrying any firearms.”
He’s also doing the Veterans Administration’s Outpatient Substance Abuse Clinic and, “is participating and has completed many family and personal counseling courses although not ordered to do so.”
Prosecutors dropped the felony child neglect charge the sheriff’s office had originally arrested Deiseroth on back in August.
Deiseroth’s next court hearing is 9 a.m. Oct. 30 before Monroe County Court Judge Mark Wilson.
Deiseroth isn’t one of the new ICE agents the federal government has been recruiting throughout the Trump administration’s immigration crackdown, Catalano told me.
Deiseroth has worked for ICE for many years, he said, and before that was a staff sergeant in the Army.
“He’s spent most of his life serving his country,” Catalano said.
Monroe County deputies pulled Deiseroth over in August after a driver reported his pickup truck was weaving into the oncoming lane and the middle of the highway.
On Friday, the body cam footage of Deiseroth’s arrest went up on social media via many accounts. Various clips and edits put the arrest back in the news cycle.
“Are we really doing this right now?” asks Deiseroth, several times after being stopped.
He mentions he’s a war veteran. He was driving his gray 2020 Chevy pickup with a Florida disabled veteran plate. In the back seat were his sons, ages 7 and 9.
On the video, Deiseroth agrees to do the DUI field exercises but asks for “a minute,” several times first, while they’re all on the side of the Bahia Honda Bridge.
“I’m federal law enforcement,” Deiseroth tells two Monroe County Sheriff’s Office deputies on the body cam. “I’m going through a divorce. My bitch-ass wife is trying to take my kids. Give me a minute, all right?”
Deiseroth then asks the deputies whether they have children and when they both say they don’t, he replied, “Exactly. So you don’t know what it’s like."
“My kids are my life,” Deiseroth says.
‘Are You Haitian?’
At one point on the bridge, Deiseroth turns to a deputy, who’s Black, and asks, “Are you Haitian?”
When the deputy says that has nothing to do with what’s going on, Deiseroth again asks, “My question is, are you Haitian?”
Deputy Jonathan Lane, who’s white, tells Deiseroth, “It doesn’t matter.”
Lane, who made the arrest, tells Deiseroth he knows what he’s going through. In 2023, Lane was arrested for DUI, after he was found asleep while off-duty behind the wheel of a car parked at a Ramrod Key gas station.
Lane’s back on the job. His case on Friday was marked “confidential” on the Monroe County Court’s website.
“Own up to your mistakes, man,” Lane tells him. “You’re a grown adult. I cried my ass off, too. Be a man. Suck it up. That’s what everyone tells us.”
Once in handcuffs, Deiseroth at first won’t get into the backseat of the patrol car voluntarily.
“Lane, you really fucked me, man,” Deiseroth says.
“I didn’t fuck you, man,” Lane replied. “I’m not the one who drank today and drove.”
