| 07/18/2025 | MINUTE ORDER: Upon consideration of the Center for Judicial Accountability's ("CJA") Motion for Leave to File an Amicus Brief, Dkt. 33 , it is hereby ORDERED that the motion is GRANTED in part and DENIED in part. The amicus brief was filed by Elena Ruth Sassower, the "Director" of the Center for Judicial Accountability, who is herself proceeding pro se. Dkt. 33 at 3. Ms. Sassower represents that "CJA is not represented by an attorney." Id. But a corporation or organization "cannot represent itself and cannot appear pro se. It must be represented by counsel." See Alexian Brothers Medical Ctr. v. Sebelius, 63 F. Supp. 3d 105, 108 (D.D.C. 2014); see also Partridge v. Am. Hosp. Mang. Co., LLC, 289 F. Supp. 3d 1, 25 (D.D.C. 2017). Accordingly, the motion is DENIED in so far as the amicus brief is filed by the Center for Judicial Accountability without counsel. The Court will, however, construe the motion as filed on behalf of Elena Ruth Sassower in her personal capacity and GRANT leave to file on that ground. Signed by Judge Randolph D. Moss on 7/18/2025. | 10/07/2025 | MINUTE ORDER: Upon consideration of NPR and CPB's Joint Motion for Scheduling Order, Dkt. 45 , it is hereby ORDERED that the motion is GRANTED in part and DENIED in part. First, the Court GRANTS the parties' request to consolidate NPR's pending motion for a preliminary injunction with a motion for summary judgment, and it will consider NPR's consolidated motion with CPB's anticipated cross-motion for summary judgment.Regarding the parties' proposed schedules, the Court will need at least a few days to consider the parties' evidence and arguments and to prepare an opinion. As such, CPB's proposal that the Court hold a hearing on the parties' cross-motions for summary judgment on October 31--which is the final day that CPB has agreed not to disperse the funds at issue--is untenable. Accordingly, the Court will hold an evidentiary hearing and will hear oral argument on October 28 at 9:30 a.m. Given CPB's representations regarding the availability of counsel, the Court will modify the proposed window for depositions to extend from October 18, 2025 to October 23, 2025, and it will give the parties until 6:00 p.m. on October 24, 2025 to serve notice on witnesses for testimony at the hearing. The Court will also modify the proposed deadlines for supplemental briefing to require that the parties' supplemental briefs be filed no later than 6:00 p.m. on October 24, 2025, and that their opposition briefs be filed no later than 2:00 p.m. on October 27, 2025. The parties shall exchange any exhibits or demonstratives that they intend to offer at the hearing no later than 6:00 p.m. on October 27, 2025. The following schedule, incorporating the modifications to NPR's and CPB's proposed schedules that are outlined above, will govern further proceedings on Plaintiffs' motion for a preliminary injunction and the consolidated summary judgment motions: October 8, 2025: Deadline for CPB to file its answer to the amended complaint.October 9, 2025: Deadline for CPB and NPR to serve all written discovery requests concerning NPR's consolidated motion for preliminary injunction and motion for summary judgment and CPB's cross-motion for summary judgment.October 13, 2025: Deadline for CPB and NPR to serve deposition notices. October 16, 2025: Deadline for CPB and NPR to serve objections and responses to written discovery requests and to complete production of responsive documents and electronically stored information.October 18-23, 2025: Depositions of witnesses.October 20, 2025: Deadline for CPB and NPR to move to compel further responses to written discovery requests. October 24, 2025 at 6:00 p.m.: Deadline for CPB and NPR to (1) file supplemental briefs and (2) to serve notice on witnesses for testimony at the October 28, 2025 hearing. October 27, 2025 at 2:00 p.m.: Deadline for CPB and NPR to file opposition briefs. No replies shall be filed.October 27, 2025 at 6:00 p.m.: Deadline for CPB and NPR to exchange any exhibits or demonstratives they intend to offer at the October 28, 2025 hearing.October 28, 2025: Evidentiary hearing and oral argument on the motions. The hearing will commence at 9:30 a.m.If CPB concludes that it can commit to withholding any distribution of funds appropriated by Congress to CPB for public radio satellite interconnection purposes until after October 31, 2025, the parties may propose commensurate modifications to this schedule. As discussed at the September 30, 2025 hearing, it is hereby ORDERED that CPB shall provide both the Court and NPR with seven calendar days' notice prior to committing itself to any contract that disburses the funds at issue. Finally, although Plaintiffs have moved for leave to file an amended complaint, the parties' proposed schedule, as well as the Court's guidance at the September 30, 2025 hearing, contemplate that Plaintiffs will be allowed to amend their complaint at this early stage of the litigation. Accordingly, it is further ORDERED that Plaintiffs' Motion for Leave to File Amended Complaint, Dkt. 46 , is GRANTED. Signed by Judge Randolph D. Moss on 10/7/2025. (lcrdm1) (Entered: 10/07/2025) | |
