SJC COMMISSIONERS: PLEASE REMOVE ITEM 29 FROM NOVEMBER 18, 2025 CONSENT AGENDA (LAMP APPOINTMENTS)



Dear St. Johns County Commissioners Joseph, Taylor, Murphy, Whitehurst and Arnold::

1. Would you please be so kind as to call me today to discuss Consent Agenda Item 29 for the next Commission meeting.   https://stjohnsclerk.com/minrec/agendas/2025/111825BCC/11-18-25CON29.pdf After public comment, please vote to delete selection of our Land Acquisition Management Board (LAMP) board members from the "Consent Agenda" for our November 18, 2025 St. Johns County Board of County Commissioners agenda, and from all future Consent Agendas.
2. No choices are provided to our Commissioners. Staff was apparently empowered to pick LAMP members. Why?  "On 'vot' theory," then Secretary of State Henry Kissinger once heckled what he considered to a bad call at a Washington Redskins football game.  As elected former Texas Agriculture Commissioner Jim Hightower would say, "They're stealing the alternatives, folks!"     
3. Supreme Court Justice Benjamin Nathan Cardozo would likely have called this a "delegation running riot."  See A.L.A. Schecter Poultry Corp v. United States, 295 U.S. 495, 553 (Cardozo, J., concurring)  (1935).
4.  Please place Consent Agenda Item 29 on the November 18, 2025 agenda.
5.  Kindly consider mediation by the Florida Attorney General's Special Counsel for Open Government..
6. Please comply with our U.S. Constitution, with Article I, Section 24 of our Florida Constitution and with F.S. 286 from this day forward. Please provide any legal authority for usurping Commissioners' powers under County Commission rules.
7. Our Board rules do not contemplate single Commissioners, or staff picking LAMP board members.
8. Our Florida Sunshine law was enacted by vote of 3.8 million people in 1992 (83%). 
9. St. Johns County Commission's Rule 4.302 provides:  


RULE 4.302 CONSENT AGENDA 

A. Contents, Approval, Changes. There shall be included on the Consent Agenda, all legislation which has received a favorable report at a previous workshop or

Commission meeting from each agency of the County which is required to comment on the same, and as to which no substitutes or amendments are pending and routine business items, not limited to, but including purchases, subdivision plats and final development plans. The Chair shall approve inclusion of the Consent Agenda as a part of the Regular Agenda for each Board meeting, and may order that legislation or business items be removed therefrom, placed on the Regular Agenda, referred to a committee or delayed to another Board meeting. After the Consent Agenda is published, no items may be added to it.   

B. Consideration. At the appropriate time, the Chair shall announce the taking up of the

Consent Agenda. Any item on the Consent Agenda may be removed therefrom for

the purpose of further debate at the request of any Commissioner, in which case the item so removed shall be debated and considered as part of the Regular Agenda or

delayed to a future meeting. After any item has been removed for further debate, the Chair shall call for one vote on the entire Consent Agenda, which vote shall be applicable to each item on the Consent Agenda (except removed items).
