State Representative WILLIAM L. PROCTOR AVOIDS AND EVADES JUNE 11, 2008 OPEN RECORDS REQUEST -- YES, PROCTOR IS A WEASEL AND HE IS OUT-OF-TOUCH

Dear Mr. Proctor:
Once again, I wrote you and told you I did not want copies. Please refer to my prior E-mails. You are being evasive and condescending. I never received any correspondence from you on July 22. Apparently you think you can charge people money to look at records when they have not designated any documents to be copied.
Please mail me the disk.
Herein faileth not.
With kindest regards,
Ed Slavin

Once again, you are being advised as to the availability of the public records you requested. I quote from your initial communication, “…please be so kind as to provide to Clean Up City of St. Augustine all paper and electronic documents concerning…” I call your attention to the word “paper.”
As to the notices you have received of the availability of this material,20our records substantiate that you were advised on 22 July, 13 September, 20 September, and 7 October. You were also informed that we have no obligation to forward the material on the disk by e-mail, and you were provided with the source of that opinion.
The question remains as to whether you have any intention to schedule an appointment to obtain the material. If not, I will inquire as to how long we are obligated to retain records requested 11 June and made available as of 22 July, the delay resulting from the time necessary to prepare the disk. This will be my last communication to you on the subject.

My dear Rep. Proctor:
1. Please mail or E-mail me the contents of the disk -- your response to my request is long overdue..
2. You never answered my question about whatever it was that possesed you to make copies that I never requested, when I asked for computer records and to look at the original documents.
3. I await a call from Mr. Jeremiah Hawkes, whose office is now aware that we have received no documents since the request was made and that we never asked you to make photocopies.
4. In the immortal words of the late Senator Daniel Patrick Moynihan, "everyone is entitled to their own opinion, but not their own facts.".
Thank you for your future compliance with our long-overdue request.

In response to your recent communication,=2 0the legal opinion I obtained regarding the service to which you are entitled, was provided by Mr. Jeremiah Hawkes of the General Counsel's Office for the Florida House of Representatives. On the basis of Mr.. Hawkes' opinion, I reiterate, once again, that the records you requested are available at the District Office, and the cost of the copies is as quoted, $74.60.
You may call in advance to schedule a time when you wish to pick up the copies and the disk.

Dear Rep. Proctor:
Thank you for your reply.
1. Would you please be so kind as to mail me the disk to Box 3084, St. Augustine, Florida 32085?
2. Is there anything that's not on the disk?
3. I am interested in reading all the documents, but did not request copies.
4. Never got anything from your secretary -- nothing in my P.O. Box. How was it sent and to where?
5. By the way, who is your counsel and how in the name of all that's holy could s/he thiink you "met your obligation" when you haven't provided a single document yet -- not one?
6. I have shared this letter to JoAnn Carrin.
7. Nope. I am not paying $74.60 for copies I did not request. See prior correspondence. Charging citizsens for copies they did not request is a tax on knowledge and an anathema to the public's Right to Know. As the great American diplomat Charles Cotesworth Pinckney said, "not one penny for tribute." For that reason, by copy of this letter, I am advising Pat Gleason and Governor Crist of your actions -- delaying compliance with my request for months, and then belatedly attempting, sua sponte, to charge me $74.60 for copies I did not request.
That was unkind and unhelpful, and does not reflect well on your "service," such as it is.

This is in response to your message of the 25th pertaining to your public records request. As you were informed by the office secretary some time ago, the records and the disk are available. There is no charge for the disk; however, there is a ten cents per page charge for the paper records totaling $74. 60. I will, on this occasion, waive the charge for staff time involved. In response to an inquiry, I have been advised by counsel that we have met our obligation to you.
If you will contact the office, we will arrange an appointment where you can retrieve the records you requested.

Dear Representative Proctor:
Thank you for your further response to the Open Records request I filed last month. Two concerns:
1. What "redaction[s]?} Exactly what do you have to "redact?" Please supply a Vaughn index for anything you claim is privileged so we can sort it out.
2. Please be frugal, save tax money and save some trees -- I want to see originals first, then designate any items to be copied. I don't want copies of everything I requested. Save our money, please.
As Thomas Jefferson said, "a public office is a public trust."
Am still waiting to hear from you about the draft SANHPNSNSCHA. Please see below.
Thank you.
