Port District ILLEGAL Vote to Authorize St. Johns County BoCC to Work Under Its USACE Summer Haven River Permit; Need for Competent Legal Advice



I wrote to St. Johns County Commissioners and staff yesterday about the illegal vote by the St. Augustine Port, Waterway and Beach District, purporting to authorize St. Johns County to work under the Port District's Summer Haven River permit, without allowing public comment

The Port District is knowingly misconducting itself, in violation of F.S. 286.0114, against the peace and dignity of the State of Florida, in violation of our Sunshine law and constitutional rights.  Enough guff from the likes of JAMES BEDSOLE and THOMAS J. RIVERS.

Dear Chairman Waldron, Vice Chairman Smith and Commissioners Johns, Dean and Blocker, Messrs. Shinkre, Wanchick and McCormack and Ms. Ross:
1. I am writing to warn, inform, advise and disclose to you that the St. Augustine Port, Waterway and Beach District's September 17, 2019 putative vote to allow St. Johns County Commission to work under the Port District's USACE permit for the Summer Haven River was illegal, ultra vires and unconstitutional, and void ab initio.  
See below.

2. The facts are irrefragable.  NO public comment was allowed before the vote, despite my handing in a card and seeking recognition. 
3. St. Johns County Public Works Director Neil Shinkre was an eyewitness to Port Vice Chairman Thomas Jefferson Rivers' rude, crude, dictatorial violation of my civil and constitutional rights on Constitution Day.
4. While other Commissioners wanted to hear my thoughts, Vice Chairman Rivers arrogated to himself the role of "the decider," contrary to the genius of a free people and in violation of my rights under the First, Ninth and Fourteenth Amendments; 42 U.S.C. 1983; Article I, Section 24 of our Florida Constitution; F.S. 286.0114(2), which provides, "Members of the public shall be given a reasonable opportunity to be heard on a proposition before a board or commission. "
5. This renders illegal, ultra vires and unconstitutional the Port District's September 17, 2019 vote authorizing St. Johns County to work under its USACE permit.
6. The next Port District meeting is at 5:05 pm on October 3, 2019. 
7. Please govern yourselves accordingly.
8. Please inform USACE of your legal and ethical quandary, and kindly do not proceed without competent legal advice on USACE permitting issues.

Dear Chairman Benjamin, Commissioners Way, Rivers, Brown and Flowers:
1. The Port District's lack of independent scientific peer review is painfully obvious from the short, swift and desultory discussion at  the District's September 17, 2019 meeting
2. It violated F.S. 286.0114(2) by refusing to allow me to speak before its vote on the Summer Haven. River project.
3. The District broke the law when it voted to give St. Johns County Public Works Director Neil Shinkre, P.E. the authorization for St. Johns County to work under its USACCE permit.  See F.S. 286.0114(2), which states, "Members of the public shall be given a reasonable opportunity to be heard on a proposition before a board or commission. "
4. The District violated my rights on Constitution Day. 
5. Please cease and desist from all future lawbreaking.

Maitane Olabarrieta, Ph.D.
Olabarrieta and her graduate students, Luming Shi and Chu-En Shu, are working on the development and establishment of a coupled wave-hydrodynamic-ecologic forecast modeling system within the iCoast project. This forecast system is being stablished and tested in the Guana-Tolomato-Matanzas estuary, and it will be used to forecast surfzone hydrodynamics, impacts of storms (erosion and flooding) and water quality. The forecast system will be used to gain understanding of the dynamics of the estuary under diverse weather conditions. The information provided by the forecast model will serve to stablish a warning system against the impacts of storms, algal bloom outbreaks and excesses of water pollution.
