Jackson Lewis Partner Tyler White Wrong to Use Phrase "Rat Out" on Radio, Stigmatizing Worker Reports to OSHA

On WJCT News "First Coast Connect," Melissa Ross interviewed Jackson Lewis law firm partner Tyler White September 13, 2021 on workplace COVID issues.   Well stated points about OSHA authority.

But Jackson Lewis partner Tyler White used the phrase "rat out" to describe what employees do when their employers break the law.  I am appalled.

Employees have rights to make reports to OSHA. 

It's called "protected activity."  

Tyler White talks like a mafia consigliere, which is exactly what employer defense lawyers do for employers in labor law. 

For Tyler White to use the phrase in a radio interview shows the debased nature of employer-side labor law.

I've left a message for Mr. White 

Pray for Mr. White, whose Pepperdine Law School Dean was twisted Kenneth Starr.

Pray for employers and employment lawyers to find decency.   Some  employer defense lawyers are uncivil, unkind and uncouth. At EPA in Atlanta, two EPA  lawyers were actually given bonuses for their oppressive tactics in environmental whistleblower cases against EPA.

Workers should ask questions, demand answers and expect democracy.

To workers: "Be not afraid."*

Biography

Tyler White is a principal and litigation manager in the Jacksonville, Florida, office of Jackson Lewis P.C. He represents and counsels employers in the public and private sector on all aspects of employment-related issues.

Tyler regularly represents employers in disputes, litigation, and arbitration involving trade secrets, non-competition agreements, non-disclosure agreements, wage hour allegations, and allegations of race, gender, national origin, disability, age, marital status, genetic information and religious discrimination. Tyler also defends employers in cases involving allegations of defamation, sexual harassment, violations of Florida’s Guns at Work law, and whistleblower and workers’ compensation retaliation.

Tyler assists employers in drafting employee handbooks and policy manuals, handling unemployment compensation appeals, and responding to Equal Employment Opportunity Commission and state and local agency charges of discrimination. He also guides employers through Department of Labor investigations involving allegations of unpaid overtime and minimum wages.

Tyler is available to speak on a broad range of employment-related legal topics and has co-written presentations and lectured at many Breakfast Series events for the Jacksonville office of Jackson Lewis. Mr. White has co-presented on subjects such as: “Employment Law in a Virtual World” (October 2009); “The Holiday Party: Laughs, Libations and Liability” (November 2009); “Fearless Firing: Saying ‘Goodbye’ without a Courthouse Reunion” (March 2010); “Preparing an Effective Employee Handbook” (May 2010); and “A Ticking Time Bomb: Do Your Handbooks and Policies Violate the National Labor Relations Act?” (January 2013).

In addition to receiving his Juris Doctor, Tyler completed further studies to earn a Certificate in Dispute Resolution from the Straus Institute at Pepperdine.
