Illegal trip to Europe for Sunshine violations, requiring investigation of Mayor JOSEPH LESTER BOLES, JR.? -- IN HAEC VERBA

August 8, 2014: UPDATE: Mayor JOSEPH LESTER BOLES, JR. will not be accompanied by any other Commissioners in Malaga, Spain at the U.S.-Spain Council meeting.

Good afternoon:
1. If St. Augustine, Florida Mayor JOSEPH LESTER BOLES, JR. and so much as even one other Commissioner go to Spain for meetings in Malaga together September 2-7, I believe that they will violate our Sunshine law and Article I, sec 24 of our Florida Constitution? (No matter who pays.).
2. That's why St. Augustine Commissioners dropped out of the Sunshine-violating plan four years ago, when Holland & Knight, representing eighteen residents, sent an Open Records requests on it.
3. What do Florida Sunshine experts think?
4. At a seminar by First Coast School of Law Professor Rod Sullivan at the County Administration Auditorium November 16, 2011 sponsored by State's Attorney Ralph Joseph Larizza, there were two laugh lines, each at PowerPoint slides about St. Augustine illegalities (First America Foundation and abortive Sunshine-violating trip to Spain). The seminar was videotaped, and some 100 local officials attended and received certificates of attendance. Professor Sullivan was clear that Commissioners attending business meetings together outside their county (or the country) would violate Sunshine laws. His presentation will be forwarded to you upon request.
5. IF any of three St. Augustine commissioners -- Mr. Donald Crichlow, Ms. Roxanne Horvath and Ms. Leanna Freeman -- should go to Spain and join Mayor Boles at any meetings in Malaga, they are already on notice -- first in 2010 and again in 2014 -- that they WILL be violating Sunshine laws. The FBI has a Legal Attache in Spain who could be asked to send agents to Malaga to gather, preserve and present evidence to a grand jury if that happens.
6. By copy of this E-mail, I ask three local officials -- Mr. Donald Crichlow, Ms. Roxanne Horvath and Ms. Leanna Freeman -- to be guided by the better angels of their nature, and to cease and desist any plans to violate the Sunshine law in Spain.
7. Please announce that you will not join Mayor Boles for any meetings in Malaga at the U.S.-Spain Council, or anywhere else.
