Relying on Illegal Policy, City Refuses to Fax "Evidence" of Its Supposed Timely Filing of July-September Reports on Sewage Plant in Lincolnville

My dear Mr. Regan:
1. When did the City Commission adopt this "policy?"
2. My information is that it was never adopted by City Commissioners.
3. My information it is not part of the City's ordinance.
4. The policy is illegal and thus remediable in federal court. 42 U.S.C. 1983, 1985, 1988.
5. You could have faxed me the requested cards on December 31.
6. You did not do so.
7. Now you emit bureaucratic flippancies -- either you filed timely or you didn't (you do not answer my questions).
8. You either have the cards or not.
9. Again, kindly fax me the cards like a normal person would do, instead of demanding 15 cents per page of copies I don't need.
10 I am sure that Allison Ratkovic can fax it quicker than she can write or send more officious E-mails (below).

Your email corespondence dated 12/30/08 at 4:39 p.m. has been referred to our
ffice for response. City staff have investigated the entry on the EPA ECHO
hree Year Compliance Status by Quarter Report for the City's water and waste
ater treatment plant showing a failure to file the DMR report for quarter 12 of
he three year compliance period.
The investigation reveals that the City submitted the DMR's in question and
ossesses certified mail receipts signed by the agency showing receipt of the
eports. In addition, the Florida Department of Environmental Protection's
ompliance representative, Karen Girard, concurs that the DMR's are on file and
ould offer no explanation wh
y the ECHO website indicates a reporting violation.
s. Girard further indicated that she will investigate the apparent error and
ave the website corrected by next month.
In summary, any error appears to lie with the EPA website and not with the City
f St. Augustine.

Mistakes, murders, mayhem and mismanaged money -- with one or two bright spots

The St. Augustine Record's editors and reporters -- after finishing off the holiday eggnog -- sat down and made a thorough review of all the news stories published in the paper during 2008, compiling our annual list of St. Johns County's top 10 stories of the year.

Generally, news reports are too often stories about unpleasant events, such as crimes, arrests, plane crashes, indictments and missing children. Readers must know these things to understand their community better, but bright spots are too few.

The stories chosen are are not in chronological order. The selection committee believes it is better to list them in order of importance as well as relevance and interest to St. Johns County residents.

Here they are:

1. Economy feels state, national pain

Real estate, home building, manufacturing, automobile sales and tourism -- all backbones of St. Johns County's economy -- were pushed into a steep downward spiral this year. Economists say Florida is one of the national leaders in the number of foreclosed homes. Improvement may not come until 2010. Fewer homes mean fewer construction jobs. That affects materials suppliers, independent contractors and home furnishing, carpet and air conditioning industries. High gas prices early in 2008 slowed tourism a little, but the drop in home values sliced chunks off everyone's largest investment. Economic pressures, plus higher grocery prices, has stressed some families into foreclosure. Two local manufacturers, Luhrs and Ideal, shuttered their factories, and other companies have cut back staff.

2. Schools cut to the bone

After already cutting $13 million from its budget, the St. Johns County School District learned earlier this month that it could face an additional $25 million cut in state funding next year, translating to an additional 12 percent of the district's budget. More teachers, particulary recently hired ones, could lose their jobs, and the county's high schools, now on seven-period schedules, might be cut to six periods next school year.

3. Commissioner indicted

County Commission Chairman Tom Manuel of Ponte Vedra Beach was indicted in September on two federal bribery charges and was suspended by Gov. Charlie Crist on Oct. 17. The FBI said it recorded 42 of Manuel's conversations with two government informants over an 18-month period. The trial is set for April 6 in Jacksonville. Manuel has maintained his innocence since word of the FBI investigation leaked out in June. Last week he filed motions to dismiss his indictment. He remains free on his own recognizance.

4. The Amphitheatre's success

The 3,500-seat St. Augustine Amphitheatre in 2008 played host to major acts, from Good Charlotte and Modest Mouse to ZZ Top and Jordin Sparks. In August, Ticketmaster listed the Amphitheatre in the Top 5 for ticket sales for touring concerts among U.S. venues with less than 5,000 seats. In December, it was named one of five finalists for an annual award given to the country's best outdoor venue seating fewer than 10,000 people, stacking it against amphitheaters in Atlanta and Los Angeles. Also in December, the facility set records for the number of children and adults visiting its Winter Wonderland, which offered a new ice slide to complement its popular skating rink with falling snow.

5. Two high-profile murder cases

Mark Dean Aldridge, an inmate from Mississippi State Prison at Parchman Farm, pleaded guilty this month to killing a St. Augustine gas station clerk in 2001. Aldridge was sentenced Dec. 12 to life for the death of Eva Lewis. That sentence is to be served after he completes a 150-year term in Mississippi for rape, armed robbery and burglary.

In another high-profile murder case, Benjamin Colenn Lightsey, 30, of St. Augustine, was charged with first-degree murder in the Nov. 9 death of his wife, Melissa Lee Lightsey, 36, whose body was found in the St. Augustine Inlet. A medical examiner ruled she died from trauma to the head, neck and face and classified the case as a homicide. Lightsey is the son of Glenn Lightsey, who served as a deputy, detective and sergeant for more than 12 years with the St. Johns County Sheriff's Office.

6. San Sebastian project in foreclosure

In late November, The Devlin Group, owner of the 13-acre San Sebastian Harbor Resort project, went into foreclosure with Wachovia Bank, owing $22 million. The project had been projected to eventually reach $200 million in value and result in city taxes of up to $900,000 per year. The Devlin Group planned to build a Westin hotel at King Street and the San Sebastian River. A marina has already been dredged at that location. Downtown merchants and city commissioners had believed the upscale project would bring needed parking to that area of King Street. A project to repave and repair utilities along Riberia Street was awaiting the project's completion. Company CEO Wally Devlin said he still has plans for the project and will legally battle Wachovia.

7. State fines the city over dumping, pipeline

St. Augustine ran into trouble with the Department of Environmental Protection twice this year. The first time was for illegally dumping landfill material into a water-filled borrow pit. The second was for not maintaining a leaky pipeline behind its Waste Water Treatment Plant in sensitive marshland. The city was fined $40,000 for the dumping. DEP requested the material be removed. The city arranged to have the contaminated topsoil taken to a landfill in Nassau County. DEP also fined the city $30,000 for the pipeline. Instead of paying the fine, the city agreed to do an in-kind environmental project and will install a new pipeline in January.

8. New county digs, new commissioners

The St. Johns County Commission and other administrative departments moved into the new $16 million County Administrative Building in September. The commission had to move from its previous building because the Criminal Justice Center needed to expand into that space. The Administration Building's project manager said the two-story structure would last 100 years. In addition to the commission's new home, the composition of the board changed. Two new commissioners, Mark Miner and Ken Bryan, were elected in November. A third, Phillip Mays, was appointed Dec. 23 by Gov. Charlie Crist to replace suspended Commissioner Tom Manuel. The commission's first official meeting is set for Jan. 6.

9. Battling State Attorneys

A 17-month battle between dueling state attorneys ended in November when the 5th District Court of Appeal kept the seal on a grand jury document that presumably criticized one of the prosecutors. State Attorney John Tanner of Daytona Beach spent more than $600,000 to block publication of a presentment issued by a Duval County grand jury under the guidance of Jacksonville State Attorney Harry Shorstein. The root of the dispute between the two went back to Tanner's investigation of alleged abuse at Flagler County jail shortly after one of his daughters was strapped into a restraint chair following a misdemeanor arrest in 2005. The presentment remains sealed. Both Tanner and Shorstein are now out of office.

10. New Veterans Administration nursing home

Construction on the $30 million, 120-bed Clyde E. Lassen Veterans Nursing Home -- planned since 2005 to serve St. Johns County's 17,500 veterans -- began on 15.3 acres off State Road 16 at World Commerce Center this year. It will be the first nursing home in Florida to be built using "green" techniques. The cost of the facility was split between the Florida Department of Veterans' Affairs and the U.S. Department of Veterans Affairs. U.S. Rep. John Mica, R,Winter Park, helped secure the federal funding. Sixty of the home's 120 beds will be devoted to patients suffering from dementia-related illnesses. When completed late in 2009, it will employ 140 people.



Many news stories published in 2008 had to be left off the Top 10 list.

The story of the Conch House Resort & Marina's expansion plans and the resulting legal battle among the St. Augustine City Commission, the resort's developers, planners and attorneys, the Davis Shores neighborhood and a federal bankruptcy court will no doubt be a Top 10 story for 2009.

Others not chosen include the Vilano Beach Town Center; the Tourist Development Council's funding; a West Augustine medical clinic opening; Northrop-Grumman's multi-million dollar contract to build naval aircraft; voter defeat of the St. Johns County Charter and one-cent sales tax referendums; preparations for St. Augustine's 450th birthday in 2015; the Legislature's property tax reform and its effect on St. Johns County's budget and services; approval of Hydro Aluminum's expansion; and the University of Florida assuming control of St. Augustine's 34 historic properties.

"Father, Forgive Them, For They Know Not What They Do"

The strange case of the November 20, 2008 St. Augustine Wreckord column by Cultural Council President PHIL McDANIEL (a/k/a PHIL THE SHILL) -- hwo the sycophants of the School Superintendent JOSEPH JOYNER who contrived to get cartoonist Ed Hall fired by the St. Augustine Wreckord is a perplexing one indeed. PHIL belongs in a Banana Republic.

Nasty retired Republican advertising millionaires have no more business dictating artistic merit than a hog has of directing Shakespeare plays or Mozart operas.

As to the School Superintendent and other officious school marms blowing their stacks about a cartoon that didn't even refer to St. Johns County, "Character counts" needs to be in their hearts and minds, not just the curriculum.

The School Board's counsel needs to teach them about the First Amendment, which he never has.

Saw PHIL McDANIEL night at First Friday Arts Walk. He blushed crimson, said hello, brushed by me and ran away, refusing to ask a single question.

In the immortal words of William F. Buckley, Jr., "why does baloney reject the grinder?"

As to Philistine PHIL McDANIEL, a/k/a "PHIL THE SHILL" a/k/a "CATO THE CENSOR," in the words of "Mr T," let me say about PHILISTINE PHIL, "I pity the fool." Now go away and quit the Cultural Council, or no respectable foundation, donor or government will ever want to give the Cultural Council one thin dime as long as you have your dirty fingers in its fisc.

PHIL McDANIEL should either resign as Chairman of the St. Johns Cultural Council, or else no government funds of any kind should ever be put in the hands of the Cultural council or anywhere near PHIL the SHILL's grubby little paws.


PHIL McDANIEL's a tinpot Napoleon, an insignificant little bully with no substance, a meddler and a self-aggrandizing narcissist. His November 30, 2008 column said it all (see below). He thinks political cartoons must be "accurate" and need to be "researched" up to his standards. What a shallow sophistc.

PHIL McDANEIL is guilty of using his uber-clout as a big frog in a small pond to get St. Augutine Wreckord cartoonist Ed Hall fired.

Now PHIL McDANIEL is refusing to face the consequences, refusing to answer questions and failing (with his cronies including the School Superintendnent) to do anything to help get Ed Hall's job back, PHIL McDANIEL has shown himself to be a weasel, a back-shooting coward, a reprobate who is unworthy of government funding or any position of trust.

No Cultural Council worthy of the name would tolerate for one minute a leader who is in favor of banning art --- not even in Wasilla, Alaska, home of Governor Palin (who toyed with book-banning but dropped the oyster and left the wharf). Here in St. Augustine and St. Johns County, we should be embarassed to have a reptile Republican reprobate like PHIL McDANIEL thinking he should be arbiter of all that's artistic, like some fascist Gauleiter who's gonna decide what artists get government approval.

By the way, I saw PHIL McDANIEL during arts walk earlier tonight -- he brushed past me, blushed red, would not shake my hand and refused to answer questions about getting Ed Hall fired. The last time I saw PHIL McDANIEL, McDANIEL resembled an obsequious ferret in heat, such a clod that when he shook the hand of Ken Bryan's brother, McDANIEL's elbow into another person's stomach (and McDANIEL didn't even apologize). Selfish, self-indulgent, self-absorbed, supercilious, simplistic PHIL McDANIEL's St. Augustine Wreckord column of November 30, 2008 got cartoonist Ed Hall fired. Until or unless McDANIEL deals with this bad karma, he is persona non grata among the artists and cultural communities which have made St. Augustine great.

Color PHIL McDANIEL colorless, the sort of dull status-seeking shell of a person Tom Wicker wrote about in his novel, "Facy the Lions," who doesn't realize that the ingrating ass-kisser demeans the ass kissed as much as he demeans himself.

PHIL McDANIEL, if you're not secure enough in your skin to speak to people who question your actions and disagree with you, you're unfit to hold public office, you should hold your head in shame, and the last thing we need is to have you as Cultural Council Czar (or Republican lord in charge of picking artists and entertainers in St. Augustine).

Only a screwed-up Scrooge like PHIL McDANIEL would be so full of himself as to refuse to urge the Wreckord to rehire cartoonist Ed Hall, whose art has graced the Wreckord for years, punching holes in pompous poohbahs (like former Mosquito Control Commissioners who voted to buy a luxury Bell Jet helicopter without commpetitive bidding).

Cartoonist Ed Hall's cartoons helped kill the Republicans no-bid helicopter deal.

Now other reactionary Republicans have apparently gotten Ed Hall fired by St. Augustine Wreckord Publisher Derek May, who refused to discuss the firing and said he would not be pressured by concerted protected activity under the First Amendment.

Sad to say, putative Democratic St. Augustine Mayor JOSEPH LEROY BOLES, JR. would like the ilk of McDANIEL decide who can paint and sell art on St. George Street and City parks. That's not unlike putting Dracula in charge of the Blood Bank. McDANIEL must have no further role in censoring, diminishing, undermmining the artistic and cultural lifeblood of our community.

Let PHIL McDANIEL leave our artists (like Ed Hall) alone and stop molesting the First Amendment for his own mendacious ego-trip. Let PHIL McDANIEL go back to advertising and sell little gimcracks for the counters of gasoline stations.

IF RICHARD NIXON were still alive, I'd quote John J. Hooker, Jr. and say that (like WILLIAM E. BROCK, III), he "should go out to San Clemente and sit at the feet of the master."

Stand up to bullies, cowards and bigots like PHIL McDANIEL. Don't send his Cultural Council one thin dime. Don't give to any groups that give money to his Culutural Council. Tell public officials what you think of politicians pressuring newspaper publishers (like Wreckord Publisher Derek May, a/k/a "Richie Rich") to get their way). Wreckord subscribers: When your current Wreckord subscription nears its end, call and tell them why you are considering not renewing it -- they censored a cartoonist, right? What have they done to investigate City Hall abuses of power? Call the Morris Communications HQ in Augusta, Georgia and ask to speak to Will Morris, IV -- leave messages with his able assistant. Don't take no for an answer (just like any good diplomat).

Ed Hall is worth having and any newspaper worth its salt would love to have him. (By the way, I bought three of Ed Hall's cartoons last month -- the two on mosquito control and the one that the Wreckord fired Ed Hall for -- perhaps it's time for an art exhibit at the Lightner Museum on "Banned and Protest Art."

Tell your friends about Ed Hall. Ask everyone you know on the Cultural Council about Ed Hall. There are several other local newspaper editors/publishers on the Board of the Cultural Council.

What do they think of McDANIEL's getting a cartoonist fired? Does McDANIEL suffer now from a lack of trust and confidence? Could it affect the future of the Cultural Council? You would think they'd want to give McDANIEL the heave-ho as a stench in the nostrils of St. Augustine.

In fact, due to McCDANIEL's dishonest November 30, 2008 St. Augustine Wreckord column, the government could bar all governemnt contracts to the St. Johns Cultural Council under government contracting law.

He wrote hateful, hostile, threatening words about Maureen Ortagus, a cancer victim whom posters have wished dead on his Plazabum.com website, expressing the desire that she be incarcerated for her First Amendment Protected Activity.

SHERIFF DAVID SHOAR needs to be held personally accountable in front of a federal grand jury for giving "significant encouragement" to the serial civil rights violators on Plazabum.com.

These are truly despicable people. GOLD wrote hateful words about the homeless published by the Wreckord on December 23, 2006, kicking off Plazabum.com Archaeological amateur WILLETT ALBRIGHT BOYER III (using the NIC of freethinker) wrote dozens of obscene posts on Easter 2006 condemning those who seek to protect St. Augustine's indigenous Native American Indian history and archaeology. Now MICHAEL GOLD spends Christmas Eve nattering about a lady he had words with while working on DAVID SHOAR's $250,000 campaign in 2004.

Why do the heathen rage? Why do the bagmen rage? Why do the wicked prosper?

Oops. The wicked aren't prospering any longer. Their sins have found them out. Two trillion has been stolen from our economy by white collar criminals. Even the white criminal criminals are being taken (by each other). As in Mississippi Burning, the rattlesnakes are turning on each other. Speaking of the wicked, have you heard about ROBERT MICHAEL GRAUBARD and the other tree-killing, land-raping, wetland-destroying speculators? They kind of remind about the story about JFK in the 1960 Wisconsin Primary. He asked in a rural district, "What's the problem with the American fah-mah today?" One of the goobers in the back hollered back, "He's stah-ving!"

Back to poor, unenlightened, unhappy MICHAEL GOLD. This unkind, uncouth, uncivil mocker is sitting at home on Christmas Eve obsessing on Maureen Ortagus and using a photograph not posted on the Internet, suggesting she should be incarcerated. What a sick twist -- the American Psychiatric Association Diagnostic and Stattistical Manual (DSM-IV-R) could offer insights galore.

Meanwhile, at 10 PM on Christmas Eve, while MICHAEL GOLD is writing hate mail on the Internet about Maureen Ortagus, I have one question -- where was MICHAEL GOLD's wife? What does Sheriff SHOAR think of his erstwhile campaign manager and fundraiser? Does he take personal responsibility for this tetched termagant and his stalking behavior directed toward Ms. Ortagus, which may violate federal criminal laws against Internet fraud and stalking?

SHERIFF SHOAR has not had anything to say in response to concerns about MICHAEL GOLD and his PLAZABUM.COM hate website -- this is freighted with the admission that SHOAR knows GOLD's actions are notoriously disgraceful but he's afraid of GOLD, who helped SHOAR raise $250,000 during the 2004 campaign.

Attacking a lady suffering from cancer at 10 PM on Christmas Eve, MICHAEL GOLD is a bad person. Only a KKK member could support his actions. Et tu, SHERIFF SHOAR?

MICHAEL GOLD is a wimp and a weasel. This petty, vindictive pusilannamous pathetic poltroonish pachydermn coward MICHAEL GOLD never did return my phone message -- as William F. Buckley, Jr., once said, "why does baloney reject the grinder?"

Now, does SHERIFF SHOAR have the guts to denounce GOLD for his stalking behavior and open an investigation of threats of bodily harm that have been posted on Plazabum.com? EPA's information on the ECHO website showed our City was late with its July to September 2008 filings on pollution from the CIty's sewage plant.

It is time for the citizens of St. Augustine to say "enough". Our community and it's viability as a prime tourism destination is threatened by gypsy panhandlers who have been informed that our city is an "easy mark."

You might be surprised to learn that the increased number of bums and freeloaders inhabiting the plaza and historic district are not just here by accident. There is an organized anarchist group known as the "Squatter Culture" who (sic) exists (sic) primarily to make what they consider a political statement.

Their manifesto (sic) message is anti-establishment, anti-government and anti-police (sic), but, oddly enough, they are very well informed about social programs and services which we make available through government subsidies, taxes, and donations.

The refusal of the Squatter Culture (sic) to work has nothing to do with their ability to work. They should not be confused with honest citizens who find themselves unemployed; in financial stress but able bodied and looking for new jobs. Squatters do not qualify for unemployment benefits because they weren't working in the first place.

Squatters should not be confused with the handicapped. They do not qualify for disability benefits because they are not disabled.

Simply put they do not work to support themselves because they refuse to support "the system." Rather, they spend their energies plotting ways to exhaust the services and programs "the system" can manage to provide.

These parasites and leeches did not randomly target St. Augustine. Their organization (sic) provides information to members through sophisticated means like the public Internet. The hobos that you see loitering around our public libraries and in cyber cafes where Internet access is freely provided are there for a reason. Once again, they use our resources to their benefit.

Tourism and travel Web sites are now issuing "travel advisories" cautioning travelers about the possibility of being approached by panhandlers who squat in our historic district. That is unconscionable.

St. Augustine is a "park and walk" tourist community and we have spent a king's ransom building a new parking facility to promote that concept. Our best efforts will be for naught if we do not take the necessary steps to rid ourselves of vagrant beggars in the historic district.

We need to send a strong message to the "Squatter Culture" that St. Augustine is no longer a "squatter-friendly" town for everyone with their hand out. We need to close down their wooded campsites along the railroad tracks and raise our voices to those who have the responsibility to enact and enforce any required ordinances.

We need to say -- in no uncertain terms -- that as a community, we are doing everything that we possibly can to protect the safety, convenience and enjoyment of visitors to America's Oldest City and that we will continue providing a premier vacation destination.

For those who are interested in this discussion or would like to add comments, a downtown merchant started a Web site where he intends to expose the problem and what some feel is the inaction of certain commissioners to address the problem properly. His site is PLAZABUM.COM and is free.

Their cowardly actions may constitute sins, torts and crimes -- including obstruction of justice when they seek to intimidate city employees and whistleblowers who disclose environmental crimes (like illegal dumping of solid waste in our Old City Reservoir and sewage effluent in our Matanzas River).

Our City's tourism is way down, in no small part because Plazabum gives us a sleazy reputation on the Internet. This low-class bunch of perverts is like the ugly billboards that greet visitors to the City -- no way to welcome tourists.

We need a St. Augustine National Historical Park, National Seashore and National Scenic Coastal Highway. Never noticed any support from the denizens of ToTT or Plazabum -- they're strictly tiresome knife-throwers with no ideas -- a public nuisance.

True good-ole-boys don’t destroy prime wildlife habitat or an historic 1923 Donald Ross golf links that also serves as a rookery.

The St. Augustine, Florida misanthropes often violate Sunshine laws and Open Records laws. They rip off taxpayers together. They laugh all the way to their banks.

Dramatis Personae, counterclockwise, from the Boss of Bosses (our own sinister St. Augustine Boss Tweed from Central Casting):

WILLIAM B. HARRISS, St. Augustine City Manager, got St. Augustine fined twice by Florida Department of Environmental Protection during 2007 and 2008, first for depositing contaminated solid waste in the Old City Reservoir and then for water pollution from a shredded sewage effluent pipe leaking into our salt water marsh (with HARRISS briefing Commissioners in private, violating Sunshine laws). HARRISS has made it his mission in life to violate environmental, Open Records and Sunshine laws, the First Amendment and citizens’ civil rights and civil liberties. HARRISS is responsible for ruining the ambiance of St. George Street and the Plaza de la Constitucion by making art and music crimes, running buskers out of town. HARRISS refused to allow the Gay Pride group to fly Rainbow flags on our Bridge of Lions, resulting in a 2005 federal court order against the City for First Amendment violations. Harrassing citizens with impunity (and seeming immunity), WILLIAM B. HARRISS has not had one (1) performance appraisal since he was hired on April 13, 1998 in a Sunshine violation meeting where John Reardon’s suggestion of a national search and performance appraisal were roundly rejected, with Stepford Wife City Commissioner SUSAN BURK saying if we hired a city manager from outside the city, they might wish to use St. Augustine as a stepping stone to a job somewhere else someday. HARRISS is still on the job causing mischief in 2009.

ERROL JONES a/k/a ERRONEOUS JONES, HARRISS’ henchman and staunchest defender on the City of St. Augustine City Commission -, made the motion to send contaminated solid waste back to Lincolnville. JONES votes frequently for misbegotten projects of speculator/developers ROBERT MICHAEL GRAUBARD and CHESTER STOKES and other campaign contributors and influential citizens. Such developers were called “worse than any carpetbagger” by County Commission Chairman Ben Rich. ERRONEOUS JONES frequently insulted citizens asking questions about illegal dumping practices and has appeared at public meetings intoxicated (as he did at the June 2008 Lincolnville Neighborhood Assn. meeting, where he caterwauled. JONES has done nothing for the Lincolnville and West Augustine communities, empowering WILLIAM B. HARRISS to commit crimes of nature there, including illegal dumping in Old City Reservoir in West Augustine, longstanding pollution by sewage effluent pipe in Lincolnville, and plans to bring the contaminated solid waste from Old City Reservoir back to Lincolnville, halted because of community opposition led by Judith Seraphin, who is running against ERRONEOUS JONES for City Commissioner, Seat 1.. ERRONEOUS JONES called Judith Seraphin a “carpetbagger,” while Judith Seraphin proudly says she’s a “Southerner by choice.” JONES narrowly won re-election and is now the Vice Mayor (or Mayor in Charge of Vice).

WILLIAM PENCE, AKERMAN SENTERFITT corporate law firm environmental lawyer, who wasted hundreds of thousands of dollars on legal and engineering fees to prevent criminal prosecution for environmental crimes. PENCE helped City of St. Augustine in unsuccessful coverup and effort to ship contaminated solid waste back to Lincolnville, the historic African-American community founded by freed slaves in 1866, which bears the brunt of the City of St. Augustine’s environmental racism. PENCE is still billing the City of St. Augustine in 2009.

DONALD CRICHLOW, City Commissioner and architect, who only recently started recusing himself from cases involving his clients. CRICHLOW is no longer Vice Mayor but is still an anti-progressive barnacle on the underbelly of the ship of life in 2009, warning other public officials not to "engage" this blogger (e.g., don't talk to dissenters -- it's the KKK way).

JOSEPH LEROY BOLES, JR, still the Mayor of St. Augustine in 2009. A putative Democrat who supports Republicans like WILLIAM. L. PROCTOR. Short on substance, he bragged his sense of humor was his best qualification for office. Will we be laughing when the bills come due for WILLIAM B. HARRISS’ reign of error?

JAMES BRYANT, soon-to-be ex-County Commissioner, wisely decided not to run for re-election, the speculator/developers’ best friend on County Commission. BRYANT enjoyed exchanging favors with developers and never saw a tree-killer he didn’t want to hug. BRYANT is no longer a Commissioner but is looking over his shoulder for feds with guns and badges to arrest him, I reckon.

CONGRESSMAN JOHN LUIGI MICA, who refuses to discuss the proposed St. Augustine National Historical Park, National Seashore and National Scenic Coastal Highway, which is supported by his general election opponent, economist Faye Armitage. MICA.helped obtain $1.1 million federal grant for City’s misbegotten, money-losing, too-big $22 million White Elephant Parking Garage, which lacks any trolleys or other mass transportation component (city could have obtained 80% federal matching funds. MICA wrote $1.5 million for federal earmark for a tunnel to the Castillo de San Marco, admittedly without consulting the City of St. Augustine or any of its citizens. MICA empowers the City of St. Augustine in its resistance to reform and environmental protection. MICA has a zero rating three years in a row from the Disabled American Veterans, favors offshore oil drilling, and head-butted an ABC News cameraman who tired to ask him questions about his attending indicted former House Republican Leader TOM DELAY’s soiree at the Republican National Convention. MICA head-butt with his hairpiece, saying “my hair almost fell off.” Damon Runyonesque MICA even wears a pinky ring. MICA spent $4.54 per vote to win re-election -- almost $1 million -- lacking substance but pushing pork. Gullible newspapers like the St. Augustine Record, Orlando Sentinel, Dayton Beach News-Journal et al. barely cover MICA but have the nerve to endorse him, based on Errors and No Facts. MICA continues embarassing our District, with recent nasty remarks urging people not to "pee on CSX' parade" (give CSX a liability waiver for passenger railroad operations) and stating that auto companies presenting their business plans to Congress would be like sharing it with people in Wal-Mart. MICA faces Faye Armitage again in 2010, and this time the likelihood of a well-funded Democratic campaign, now that local Democrats have tasted victory. Sweet!

PIERRE THOMPSON, who on October 8, 2001 cut down a bald eagle nest tree and whose THOMPSON BROTHERS REAL ESTATE company pled guilty to Migratory Bird Treaty Act crimes earlier this year. In sharp and marked contrast, Florida Power & Light, cellular and regular telephone companies and other corporations preserve, protect and defend bald eagle nest trees. Philistine socialite PIERRE THOMPSON is the grandson of the founder of the St. Augustine Record and a friend of city and county commissioners. THOMPSONS built at least one ritzy subdivision a wetland, with thousands of tons of fill. THOMPSON’s longtime lawyers were the estimable former St. Augustine City Attorney GEOFFREY DOBSON and current City Attorney RONALD BROWN, who did not recuse himself from actions affecting THOMPSON’s interests. I am proud that I helped give our new U.S. Attorney’s office a spinal implant, after the statute of limitations was almost allowed to expire under U.S. Attorney Paul Perez. IF THOMPSON had cut down an eagle nest tree in the Eastern District of Texas, the Justice Department would have thrown the book at him and imprisoned him for violation of the Migratory Bird Treaty Act, the Bald and Golden Eagle Protection Act, and the Endangered Species Act. THOMPSON was also involved in tearing down two downtown African-American neighborhoods during 1964 (just before our City’s 400th Anniversary). Of course, the St. Augustine Wreckord is loathe to criticize THOMPSON, and you'll learn more about what he did from Deirdre Conner's stories in the Jacksonville Tims-Union (also owned by MORRIS COMMUNICATIONS) than from the cowardly Wreckord.

CHESTER STOKES, Jacksonville, Florida real estate speculator/developer campaign contributor to St. Augustine City Commissioner ERROL JONES a/k/a ERRONEOUS JONES, et al., CHESTER STOKES won St. Augustine City Commission annexation and zoning approval to destroy a 1923 Donald Ross golf links for speculative housing project (and then won city approval to treat the land as a “brownfield,” receiving over $1,000,000 in tax breaks, which the legislature never intended for destroying an historic golf course to build houses for the rich).

WILLIAM L. PROCTOR, Flagler College Chancellor and 20th District State Representative, who refuses to discuss the proposed St. Augustine National Historial Park, National Seashore and National Scenic Coastal Highway. PROCTOR is Republican lord of all he surveys in St. Augustine, paying the City the grand sum of $121,000/year for police services, a small fraction of the property taxes on $120,000,000 Flagler College properties, while draining the city of revenue every time Flagler College takes over another building. FLAGLER COLLEGE has few non-white students or professors and has until recently discriminated against GLBT students, dragging its heels for years in recognizing Club Unity. PROCTOR is known as “MASSA PROCTOR” to FLAGLER COLLEGE employees. FLAGLER COLLEGE is a right-wing rich kids’ school with no tenure for the faculty, no academic freedom, no unions and a censored school newspaper. A former football coach who writes nasty letters to constituents who disagrees with him (even insulting them in person), WILLIAM L. PROCTOR is an egotistical, angry, hierarchical, authoritarian control freak who got his job by apple-polishing for the illegitimate heirs of Henry Flagler, the brains behind the Standard Oil Trust. PROCTOR is responsible for taking the Spanish Garden and rules FLAGLER COLLEGE with an iron fist. PROCTOR’s an unpredictable, erratic, insufferably mean-spiroted bully aged 75, a throwback to the days of Jim Crow and one-party rule, an energumen in whom voters lack trust. PROCTOR’s hot under the color because Democrat Doug Courtney is running against him for the 20th District State Representative seat, winning support from diverse residents who want real representation. In 2009, Proctor's FLAGLER COLLEGE faces questions about why so few African-Americans apply there -- of some 2700 African-American students who receive Flaglar College literature, less than 100 apply -- could it be because the eau d'racism that permeates FLAGLER COLLEGE, from its all-white cheerleading squad to its nearly all-white faculty? The Office of Civil Rights in the Department of Education is expected to look more deeply into FLAGLER COLLEGE and whether it's violating anti-discrimination laws in a city where segregationists ran the town.

MARK KNIGHT, St. Augustine Planning and Zoning Director, hired by HARRISS on April 18, 1998 after losing his position in Lake County. KNIGHT is nothing but a lapdog for the likes of ROBERT MICHAEL GRAUBARD, CHESTER STOKES and other speculators who have tried to destroy St. Augustine and St. Johns County with wetland-killing, tree-cutting chicanery. MARK KNIGHT remains the speculators' best friend in City Hall (other than WILLIAM B. HARRISS, their avatar).

GEORGE McCLURE, a developer lawyer formerly with ROGERS TOWERS law firm, got everything he ever asked for from St. Augustine City Commission and St. Johns County Commission, including winning permission for clients to destroy wetlands and build homes in marshes, while destroying a 3000-4000 year old indigenous native American Indian village for a strip mall and condos on Red House Bluff. McCLURE's latest project is trying to foist off a one cent sales tax so developers can be bailed out, with no strings attached. That project failed. More successful was McCLURE (and a developer) bribing Republican County COmmission Chairman THOMAS GLAIZE MANUEL, who is under indictment for bribery. This leads to the question, did McCLURE get witness protection status? Was this the first time McCLURE ever gave money to a politician? Did the feds have McCLURE dead to rights on other crimes, leading him to wear a wire with Chairman MANUEL?

JOHN REGAN, Chief Operating Officer of City of St. Augustine – he’s WILLIAM B. HARRISS’ "hey-boy," feverishly, fronting for HARRISS in dealing with communities victimized by St. Augustine’s environmental racism. REGAN refused to hold meetings in Lincolnville on the City's illegal dumping of sewage effluent in saltwater marshes. He held a meeting at City Hall instead. He said no one from the public attended, but later NANCY SIKES-KLINE (now a Commissioner) implied at a Commission meeting that she had attended. 2009 will show whether REGAN tells the truth about HARRISS to the FBI and a federal grand jury, or bets the farm on a boss who abuses the staff and likes to think he is Republican lord of all he surveys --- WILLIAM B. HARRISS.

And last but certainly not least in our ST. AUGUSTINE ROGUES' GALLERY for 2009, there’s ex-City Commissioner SUSAN BURK, who adamantly defends HARRISS. On April 13, 1998, she said if we hired a city manager from outside the city, they might wish to use St. Augustine as a stepping stone to a job somewhere else someday. She joined JONES in insulting persons who asked about the City’s illegal dumping in the Old City Reservoir. She’s the ex-girlfriend of tree-killer ROBERT MICHAEL GRAUBARD, who has allegedly bragged about using her influence and floor-planning her campaigns. GRAUBARD was forgiven a $15,000 tree-killing fine outside the ordinary course of business. BURK has laughed at citizens contemptuously when raising concerns about misfeasance, malfeasance, nonfeasance, waste, fraud and abuse. BURK is full of herself, playing with her hair and computer during Commission meetings, rolling her eyes, even remarking that it was “insane” to consider a public power utility for St. Augustine and St. Johns County, saying it was “a no brainer.” No, a "no-brainer" would be exercising effective government oversight after WILLIAM B. HARRISS was caught-red handed depositing 40,000 cubic yards of contaminated solid waste in the Old City Reservoir and lying about it (he told former Mayor George Gardner it was "clean fill," to which EPA's John Marler replied, "there's no bedsprings in clean fill." POMPOUS DEVELOPER PHIL MAYS DID NOT HANG THE MOON




Having studied astronomy, I can assure the readers of the Ponte Vedra Recorder and St. Augustine Wreckord that Republican carpetbagger-developer PHIL MAYS did not hang the moon. This is what the pompous pachderm (a "lifelong Republican") said on the day of his coronation by GOVERNOR CRIST, who says at MAYS' house when in Ponte Vedra:

"I will continue to exemplify (sic) the same devotion (sic) I have shown to civic and community involvement in my new public service role. To those who have encouraged and supported me in this effort, I thank you for your faith in my abilities. To the current County Commissioners and County Staff, I look forward to working with you. Again, those who "supported" Mays "in that effort" are the ancien regime, which left its fingerprints. Gov. Charlie Crist's appointment of Phil Mays as interim District 4 St. Johns County Commissioner brings the commission back to its full complement of five members.

It closes the gap in the commission left when Crist suspended County Commissioner Tom Manuel, also the commission's chair, on Oct. 17 after his indictment on bribery charges. That left only four commissioners. If they had deadlocked 2-2, even good legislation would have automatically failed without the fifth vote.

Crist says Mays will serve for the duration of the suspension. Manuel's trial is due to start in April. If the charges are dropped or Manuel is acquitted after a trial, Crist would have to reinstate Manuel. His term ends in 2010.

As owner of Mays Equities, Inc., Mays has expertise in real estate investments. He knows the ropes when it comes to dealing with local governments from the other side of the dais. He also knows the needs of broad regions of St. Johns County: his home territory, upscale Ponte Vedra Beach, and West Augustine, a community in transition. He is a member of the Ponte Vedra Beach Coalition and the West Augustine Community Redevelopment Area (CRA) Advisory Board.

He holds two degrees from the University of Florida, a bachelor of arts in political science and a law degree. He is a member of the Florida Bar and the Georgia Bar.

He can draw on his experiences and expertise as he deliberates as a county commissioner.

Mays, in a statement released by the county administrative office, said, "I am committed to working with the families of our county to assure a bright future for all. As a member of the business community, I am determined to see a strong surge in economic opportunities for our workforce. St. Johns County has a rich and distinguished history. I have a respect for its past, and I pledge to all citizens I will work to assure its future."

We welcome his pledge to help the county meet the need for more job opportunities for our citizens. A major priority of our county government should be job growth.

Phil Mays of Ponte Vedra appointed as Interim Commissioner

St. Augustine, FL – (December 23, 2008) – The Office of the Governor of the State of Florida has announced that Phil Mays of Ponte Vedra has been appointed by Governor Charlie Crist to fill the St. Johns County District 4 Commission seat. The seat has been open since October 17, 2008, when Governor Crist suspended Commissioner Thomas Manuel from office, and Mays will serve for the duration of the suspension. Commissioner Mays will complete all required steps, including filing financial disclosure and taking an oath of office, prior to the next Board of County Commissioners meeting on January 6, 2009.

Mays brings a significant legal and financial background to the position. He earned a law degree from the Univeristy of Florida in 1991 and is a member of the Florida and Georgia Bar. He has worked for the past 12 years as principal owner of Mays Equities Inc., and prior to that worked as legal counsel in both corporate positions and law firms. Mays also serves on the Ponte Vedra Coalition and the West Augustine Community Redevelopment Area (CRA) Advisory Board.

Mays said his goal is to bring a businesslike and professional demeanor to the decision-making process for the County. He provided this statement:

County Commission Needs to Direct County Attorney To Draft Public Nuisance Suit Over Asphalt Plant in Residential Neighborhood

See article below. On January 28, 2005, I first saw Ken Bryan speak about the asphalt plant before County Commission. He wsa right then and he is right now.

Now is the time for County Commissioners to join Commissioner Bryan in protecting the public from a public nuisance. Commissioners need to vote to bring a public nuisance action against APAC, directing that the County Attorney prepare a public nuisance lawsuit and a memo for their review.

On January 28, 2005, a hack Assistant County Attorney told me that her job was to represent Commissioners, not residents. Likes were told to Commissioners by the Assistant County Attorney and by some lugubrious goober from the Florida Department of Environmental Protection (DEP or "Don't Expect Protection" as my friend David Thundershield Queen calls it) -- they claimed the problem was with "old people," and "the weather."

Florida public nuisance law must be used to protect the public -- just as it is elsewhere. We've had enough of all-Republican Commissioners being lemminglike and deferential to unscholarly, callous legal advice" from the likes of County Attorney DAN BOSANKO, GEOFFREY DOBSON and the others whose only legal function is to count to three and tell Boards what they think they want to hear, whether spending millions of dollars without competitive bidding (the mosquito control helicopter we all helped kill) or destroying our environment.

Continuing pollution from APAC is a public nuisance. The plant can easily be moved.
Inasmuch as ASHLAND sold the plant to an Irish multinational corporation, our words now may be heard through the IRISH EMBASSY and State Department.

Let the legal institutions of this county be used at last to protect the people.

Pollution Partners: ASHLAND OIL and St. Johns County

A controversial asphalt plant close to homes and businesses runs day and night. Choking on visible, black, sooty, air pollution, one local businessman telephoned "911" last year.

He and other St. Johns County residents have become sick, some even hospitalized, because of air pollution from an asphalt plant on SR 207. It is owned by ASHLAND INC., which is an $8 billion/year Fortune 500 company. ASHLAND is a polluter, convicted felon, and petroleum/transportation/construction/chemical company based in Covington, Kentucky. Its ASHLAND PAVING AND CONSTRUCTION (APAC®) subsidiary is America's largest asphalt paver, working for governments, developers and industrialists.

Asphalt plants have been associated with severe health problems (some studies suggest they bring losses of property value up to 56%). A Miami Township, Ohio Marathon-ASHLAND asphalt plant exploded March 20, 2004, requiring evacuation orders.

County residents are petitioning EPA investigators to probe why the plant was placed in a residential area -- and to decide whether to "suspend and debar" ASHLAND from all government contracts. Residents are asking the county to file a "public nuisance" lawsuit, to order the asphalt plant's removal, and for free public access to copies of the county's APAC® records.

In 2004, APAC® paid the State of Florida a $5250 fine/costs for its SR 207 air pollution. The St. Augustine Record carried front-page reports in 2004-2005 of air pollution, hospitalizations, respiratory illnesses, and a temporary plant shutdown.

ASHLAND Senior Vice President and APAC® President Garry M. Higdem, a Professional Engineer (also President and CEO of Transportation Construction), told me on February 8, 2005 that he took personal supervision in "considering" moving the plant (a trial balloon announced in a St. Augustine Record article on March 1, which spoke only of "smoke" and "odor," not pollution).

In response to community organizers, EPA and Florida Department of Environmental Protection (DEP) ramped up enforcement activities. The DEP issued two warning letters and seemed likely to achieve a consent order/fine with ASHLAND. Rick Banks, Environmental Manager, Florida DEP, said February 18th that seven inspectors in recent weeks spent "half their time on this one plant" (one of 300 DEP-regulated facilities in nineteen area counties). They now report that ASHLAND is installing a larger "baghouse" to reduce its air pollution, but the plant shows no sign of moving.

On February 8th, ASHLAND's Higdem directed his staff to research "odorants" (substances that conceal odors). Ten days later, ASHLAND was still "researching." When told that odorants were easily available on the Internet, he called back shortly and said a "cherry-flavored" odorant will be used. Residents report ASHLAND once attempted to use LYSOL® to clean up its kiln odors (the manufacturer's Material Safety Data Sheet warns against heating LYSOL®). Higdem said, "It is absolutely not true."

"Grandfathered"
SR 207 citizens complained to the St. Johns County Board of County Commissioners (SJCBCC) in April 2004. Then-Commissioner Marc Jacalone asked, "It's there legally, isn't it?" Commissioner Karen Stern agreed the plant was "legal." In 1999 ASHLAND asked -- and the county government allowed and approved -- locating an asphalt plant "grandfathered" in a residential neighborhood on SR 207 (just before county zoning laws changed to distinguish between "light" and "heavy" industrial uses). County Zoning Manager Rosemary Yeoman told me January 31st that the SJCBCC did not need to vote -- "it had proper zoning.... which permitted heavy industrial." Referring to a newspaper ad about the changes, Yeoman claimed "residents were given notice in 1983 when the rezoning went through."

ASHLAND's Higdem asked me February 18th, "Why would the county have had this county-zoned industrial" to allow asphalt, ready-mix, incinerators and other industrial plants in a residential neighborhood? Good question. (Higdem then said it was like "playing Monday morning quarterback" to question the plant's location.)

Since APAC®'s 1999 opening in a residential neighborhood, SJCBCC and other governments have awarded ASHLAND contracts. SJCBCC approved adding a rock crusher and other facilities.

Zoning Director Yeoman said, "I'm not aware of where the asphalt plants are -- I've not done research on where any asphalt plants are located." ASHLAND's Higdem claims there is an "incinerator" nearby, possibly contributing to the pollution. "I could not tell you the address," he said -- it's "anecdotal." Higdem suggested the pollution source "might" be railroad locomotives or a "ready-mix plant," asserting the "soot is not coming from this plant," never providing proof. Florida's DEP disagrees, and ASHLAND paid the fine in 2004.

Highway freight could double in 20 years, says former APAC® President Charles F. Potts, President of Heritage Paving, with operations as far away as China, currently Chair of the asphalt trade association, and who worked for sixteen years for Florida's Transportation Department. (An APAC® website brags of receiving "many¼awards for safety and quality" from the Florida Transportation Dept.) In 2004, Potts told paving executives about a $284 billion highway bill (passed by the U.S. House on March 10, 2005): "we must grab hold of the opportunity ... to set the stage for the kind of long-term vision that will not only keep our transportation system viable and vital" keeping America "prosperous, protected and strong." Meanwhile, SJC residents have trouble breathing.

Governmental Assurances Untrue
Writer David Thundershield Queen once opined that under Governor Jeb Bush, Florida DEP really stands for "Don't Expect Protection." For over five years, there was no sampling or continuous air monitoring. The DEP only measured the number of particles and their size, based on weak DEP regulations and severely limited in what it can do by the county's own questionable 1999 zoning decision.

On January 26th, Florida DEP inspector Christopher Kirts and Assistant County Attorney Laura Barrow inaccurately told SJCBCC that ASHLAND's subsidiary was "not violating its [air pollution] permit," postulating the problem "might" originate in "recent cold and windy weather." DEP's Kirts said Assistant County Attorney Barrow's presentation was "perfect," stating it was primarily "older people" affected because they're more "sensitive" to pollution. Barrow said there was a "problem with those folks claiming (sic) they have breathing problems."

Two days later, DEP inspected and found ASHLAND's kiln to be "cracked," with a "seam" contributing to illegal air pollution, leading to two warnings and work on a new enforcement action. Oops.

On January 26th, Ken Bryan (who recently opened an upholstery shop near the plant) told SJCBCC that he was sick three days the prior week, his "head hurting" and "throat hurting." He asked what the permit allows, but No one answered him. Rebutting the "old people" remark, Ken Bryan said he is a healthy, 56 year old, 36-year U.S. Justice Department employee who runs marathons. The Record never quoted him in its January 27 article and instead spun the issue toward pollution partners SJCBCC/APAC®, not naming ASHLAND. ASHLAND representatives sitting in the audience Jan. 26th never explained its position, Bryan reports.

Ms. Thelma Lewis, 75, believes ASHLAND is the problem, not the nearby Southern Villas senior citizens with respiratory problems who have required hospitalization. On March 1, the Record reported that she was circulating a petition "against" APAC®, never quoting its specific requests of EPA and the county (suspension, debarment and public nuisance litigation).

At the January 26th SJCBCC meeting, DEP's Kirts admitted ASHLAND's SR 207 asphalt plant is "a public nuisance," defined as causing "annoyance to the community or harm to public health," for which Florida law provides remedies, no matter what "permits" or regulations say. Called on January 28th, Barrow dismissed the possibility of a county nuisance suit on its citizens' behalf, incorrectly asserting to me the existence of state and federal "preemption" of public nuisance suits, despite precedents to the contrary (asserting her only "clients" were County Commissioners, not sick SR 207 residents).

Residents petitioned the county to file a "public nuisance" lawsuit to abate ASHLAND's "nuisance." Commissioner Stern met with residents and publicly supports moving ASHLAND's plant.

Commissioners were told on January 26th that there was no rush to award a new ASHLAND contract, with a need to prioritize Ponte Vedra road-building needs. There was time to "investigate."

Yet on February 23 Stern made a motion to award a new $1.2 million contract February 23rd. The vote was 5-0, with no mention of a public nuisance suit (or the enforcement of environmental provisions Stern had inserted in the previous contract). No one mentioned that ASHLAND was a convicted felon or discussed its worldwide record. Stern berated the (unnamed) author of an E-mail for stating the Commission was ill-serving Route 207 residents, stating she spoke to two ASHLAND lawyers and an Assistant County Attorney, claiming Ponte Vedra's asphalt would come from Jacksonville. There was no discussion of public opposition. There are over 175 signed petitions from Route 207 residents supporting suspension and debarment of ASHLAND from all government contracts. ASHLAND refused to attend a local broadcast TV debate with Ms. Thelma Lewis and Ken Bryan taped February 25th: program host Norma Sherry provided an empty chair for ASHLAND. Asked for copies of their board minutes discussing the plant, ASHLAND never provided them. Since January, the office of SJC Administrator Ben W. Adams, Jr. has stalled citizens on document and fee waiver requests and filing a nuisance suit.
In Harm's Way
Asphalt pollution became notorious thanks to the St. Augustine Record's reporting. In harm's way by APAC® are Osceola Elementary School, St. Joseph's Academy Catholic High School, Little League baseball fields, a nursing home, Southern Villas (federally-owned HUD senior citizens' apartments), a home for the retarded, and other residences and businesses. One asthmatic student assigned to Osceola was transferred elsewhere at their parents' request. Some seniors must stay indoors, breathing oxygen. Some people who have never had breathing problems were hospitalized.

People are collecting black sooty air pollution samples from their cars and air conditioner filters. Commissioner Stern reportedly promised to have them analyzed, but no results were revealed as of April 1.

Seemingly untouchable, APAC® has lucrative state and county paving contracts for I-95 and other roads. ASHLAND's Higdem said APAC® operates in fourteen Southern and Midwestern states with over 60 quarries and aggregate production facilities, 12 ready-mix concrete plants, 226 hot-mix asphalt plants, and over 7,000 pieces of mobile equipment.

A December 2004 Duke-University of North Carolina study found sixteen times higher suicide rates in communities with asphalt plants - compared to the statewide average according to psychiatrists working in conjunction with the Center for Disease Control, with 6.4 times higher brain cancer rates. Hydrogen sulfide, benzene, volatile organic compounds, and other dangerous chemicals were believed responsible.

Asphalt fumes are known poisons, and the EPA reports that asphalt-processing facilities are "major sources of hazardous air pollutants such as formaldehyde, hexane, phenol, polycyclic organic matter, and toluene. Exposure may cause cancer, central nervous system problems, liver damage, respiratory problems and skin irritation." ASHLAND's Higdem disagrees but never said why.

Asked if she would like to read the December 2004 UNC-Duke study on suicide rates in neighborhoods with asphalt plants, County Zoning Manager Yeoman told me January 31st, "No sir, I really wouldn't -- it's not a function of this department -- I would not have any reason to -- it's allowed...under the regulations of the county." She also added, "this department handles zoning -- public health is not part of our purview." She then wanted to know "why you're asking these questions?" On February 8th & 18th, ASHLAND's Higdem had not yet seen the study and had no comment, observing on the 18th, there are "lots of studies that get done."

Yeoman told me, "Not all rezonings have been approved." She was unable to name one single rezoning that had not been approved. Diane Rodgers, Special Projects Editor for the St. Augustine Record, investigated and reported that developers won 147 of 149 votes before SJCBCC in 2003, approving the clearing of “more than 33,000 acres and build[ing] tens of thousands of homes in the next ten years.” That’s a lot of asphalt.

ASHLAND A Convicted Felon
When SJCBCC awarded a new contract on February 23rd, Commissioners did not discuss the fact that ASHLAND has a long criminal history:
In 2003, found guilty of air pollution in Minnesota and put on probation (possibly violated by asphalt pollution here)

Pled guilty to bid rigging in Tennessee and Virginia in 1982, agreed not to engage in collusive bidding activities in the future, fined $7.8 million

Made $100,000 illegal campaign contribution to President Richard Nixon

Agreed to an SEC consent decree to cease corporate bribery, after admitting illegal bribes in Oman in the Middle East

Settled pollution lawsuits with over 700 residents in Kentucky and West Virginia

In August 2004, was indicted by a Missouri federal grand jury for highway bid rigging, acquitted by jury trial in October 2004. ASHLAND's Higdem credits lying government witnesses and hearsay for APAC®'s acquittal.
Judge: "Why in the world should I believe you?
ASHLAND pled guilty and was fined $9.1 million by a federal judge in 2003 for explosions and fires at its St. Paul Park, Minnesota refinery, severely injuring one worker and injuring others. ASHLAND failed to seal a manhole, violating the Clean Air Act and rules regulating refinery sewer systems, with workers injured on May 16, 1997, pumping hydrocarbons into the refinery's sewer system for treatment and recycling, igniting into a fireball when vapors escaped through an improperly sealed manhole. A second explosion erupting from a manhole injured six ASHLAND firefighters, one severely.

With two injured workers watching, an ASHLAND Vice President apologized to District Chief Judge James Rosenbaum for "lapses" that led to the "accident," claiming that the company was "truly sorry." Citing ASHLAND's environmental lawbreaking history, Judge Rosenbaum asked, "Why in the world should I believe you?'' In 2004, ASHLAND won its federal appeal, with the Eighth Circuit holding that its criminal probation should not require it to be responsible for environmental protection at the Minnesota refinery, which ASHLAND sold after the explosions to a joint venture run with USX subsidiary MARATHON OIL, with ASHLAND now owning 38%.

In Texas City, Texas, a contractor's crane ruptured a tank at a Marathon refinery on October 30, 1987, releasing a hydrofluoric acid vapor cloud, sending some 1000 residents to hospitals. Calling in lawyers before calling "911" or local schools, Marathon allegedly hornswoggled releases from lung-injured residents, paying only nominal sums, though some young and old people became lung cripples for life. Texas courts ordered disclosure of Marathon's supposed "attorney-client privileged" documents. There was a settlement with residents who sued for fraud. Then the crane contractor's insurance claim backfired, with the Texas Supreme Court upholding an absolute "pollution exclusion" in 1995.

In 2001, Marathon-ASHLAND settled with EPA, agreeing to spend $265 million to reduce pollution at Texas City and six other refineries, involving 5% of U.S. refinery capacity.

Pittsburgh River Killers
In Pittsburgh on January 2, 1988, an ASHLAND above-ground storage tank broke, sending 3.9 million gallons of diesel oil rushing out in a tsunami, with 750,000 gallons leaving its property, much of it entering into the Monongahela and Ohio Rivers, contaminating drinking water supplies, killing 11,000 fish and 2000 birds, disrupting drinking water for two million residents of Pennsylvania and surrounding states, polluting 200 miles of rivers -- one of the most severe inland oil spills in American history. It was preventable. The Commonwealth of Pennsylvania found that ASHLAND failed to:

.... find the flaw and establish relevant material properties...ASHLAND, its employees, and some contractors displayed a pervasive pattern of negligence and ignorance in selecting, assigning, constructing, supervising, and inspecting the reconstruction project....The negligent conduct by ASHLAND ...allowed the tank to collapse not only caused extensive environmental damage and widespread community dislocations, but also risked serious or fatal bodily injury.
Pittsburgh cost some $32.25 million in fines and settlements -- "to ASHLAND ... about as painful as the fine you would pay ... for a parking violation," Robert Sherrill wrote. Fish reportedly started returning ten years later.

Elsewhere, ASHLAND was fined $106,000 by Ohio in 2003 (for not replacing vegetation and other pipeline construction violations) and $650,000 by EPA in 2004 (for hazardous waste violations in Michigan).

Illegal Cash Contributor To Nixon
ASHLAND and its then-CEO confessed to giving the Committee to Re-Elect the President (CREEP) a $100,000 illegal cash campaign contribution, part of Nixon's Watergate scandals --charged falsely to Gabon, an African subsidiary. ASHLAND's then-CEO Orin Atkins wrote to a stockholder that, "There was a good business reason for making the contribution and although illegal in nature, I am confident that it distinctly benefited the corporation and its stockholders."

Testifying before the Senate Watergate Committee, Atkins claimed the $100,000 produced no "distinctive benefit" for ASHLAND, saying it was intended to "give us a means of access to present our point of view to the executive branch of the Government." Atkins agreed with Senator Sam J. Ervin, Jr. (D-N.C.) that Nixon's fundraising "very much" resembled extortion. Sen. Ervin told Atkins "it certainly is a human weakness or desire for anyone engaged to business to have a friendly ear in Government." ASHLAND's then-CEO Atkins soliloquized:

"...the situation is difficult to rationalize. We were not seeking any particular privilege or benefit because we don't do any significant business with the Government....all we were attempting to do was to assure ourselves of a forum to be heard. Were we a larger factor in our respective industries, we could expect to have access to administrative officials in the executive branch of Government with ease, but being a relatively unknown corporation, despite our size, we felt we needed something that would be sort of a calling card, something that would let us in the door and make our point of view heard. We didn't expect those points of view to be accepted, but only from the point of view of being able to express them and that was our thinking or rationale as to why we were interested in making any type of contribution."
Three days after paying $100,000 illegal cash to Nixon's campaign, ASHLAND representatives met with Nixon's Office of Emergency Preparedness (OEP), seeking to secure more crude oil. The Senate Watergate Committee concluded there was "no evidence" the $100,000 and subsequent meeting were connected.

Atkins stayed on as CEO until 1981. In 1988, Atkins pled guilty to providing stolen documents to the National Iranian Oil Company, receiving probation.

Worker Deaths: OSHA Found "Willful" Violation in Jacksonville
Road building and quarrying are dangerous, but sometimes ASHLAND workers die preventable deaths.

In 2004, APAC® employee Hardney L. Rush was electrocuted by a 7200 volt power line at a Missouri limestone quarry. This tragedy was found by the Federal Mine Safety and Health Administration to be the result of APAC® managers' unsafe policies, controls, and procedures.

USDOL Occupational Safety and Health Administration (OSHA) fined APAC®-Florida $112,500 for "willful" violations in a December 22, 1999 death on San Jose Blvd. in Jacksonville, where a worker was crushed by a five ton pipe in a nine foot trench, after defective hoisting and rigging gave way, killing the man in a trench lacking shoring or exit ladders.

As Pulitzer Prize winning New York Times reporter David Barstow found in 2003 and later stories, OSHA rarely finds “willful” violations in worker deaths, hampering victim families’ lawsuits and criminal prosecutions. Against this background, the 1999 “willful” violation and large fine against APAC®-Florida are both significant. Construction trench deaths are among the most easily preventable worker deaths.

Contracts, Lobbying and "Contributions"
The Center for Public Integrity (CPR) calculates that during 1998-2003, ASHLAND and its Political Action Committees (PACs): × Spent $5,905,000 on lobbying expenses; × Gave 88.36% of its campaign contributions (some $1,227,945) to Republican candidates and gave 11.64% (some $161,825) to Democratic candidates; × Gave Republican Party committees $416,730 and Democratic Party committees $42,875; × Gave $23,050 to President George W. Bush and $25,858 to Sen. Mitch McConnell (R-KY)(most prominent Congressional opponent of campaign finance reform), $21,300 to House Transportation and Infrastructure Chairman Rep. Don Young (R-Alaska)(sponsor of two earmarked "bridges to nowhere"), among other large contributions.
ASHLAND's multi-million dollar investments in politics and politicians were evidently repaid many times over. The CPR reports that during that same 1998-2003 time period, ASHLAND received $111,649,608 in payments from U.S. Department of Defense (DOD) contracts alone --over 51% of which were won with only one or two bidders.

According to antitrust experts, little competition can be a sign of monopoly power or bid rigging. In 1983, President Reagan signed an Executive Order that eliminated the Kennedy Administration's inexpensive government purchasing antitrust initiative -- publication of identical bids in government procurement -- supposedly to save money and restore "efficiency."

ASHLAND Defender Marc Jacalone: “Harassment”
Former SJCBCC Chairman Marc Jacalone was a prime mover for APAC® contracts/favors. SJC residents Carla Cowan and Glen Tilley successfully complained to FEC about Jacalone in August 2004. On March 4, 2005, the Florida Election Commission (FEC) found "probable cause" on 24 election crimes by Jacalone (Commissioner from 1996-2004). -- including FEC charges of abusing his campaign funds to make illegal contributions to other local, state and federal candidates (including the Bush/Cheney presidential campaign, the SJC Republican Party, former St. Augustine City Commissioner Bill Lennon, successful Airport Authority candidate Randy Brunson and legislative candidates Wiley Deck and Kerry McCarthy).

Defeated last year, Marc Jacalone sold his interest in his family gasoline station. Jacalone now sells commercial real estate whose rezonings he obtained as Commissioner (working for Coldwell Banker). I called Jacalone March 10 and asked whether one of his real estate listings could be a site for an asphalt plant. He asked, "Are you APAC®?" Told I was not, Jacalone seemed disappointed. While insisting APAC®'s asphalt plant was "not in a residential neighborhood," he incorrectly claimed it was there before 1999 (contradicting Yeoman). When asked if he would be requesting a hearing on the Florida Election Commission's 24 findings of probable cause, Jacalone responded, "I don't know about that -- I don't think that's any of your business, number one -- it has nothing to do with you." Asked if it was pertinent to growing perceptions of county political corruption, Jacalone said, "Gotta go, talk to you later," disconnecting.

I asked Jacalone March 11th if he knew that ASHLAND was a convicted felon when moving to award it contracts. Jacalone did not respond, hollering, "This is phone harassment... I want you to know that when I hang up with you, I'm calling the Sheriff's office." Sheriff David Shoar confirmed in writing that Mr. Jacalone did not call or file any complaint. What does Jacalone have in mind? Some SJC politicians and businessmen "call the cops" at the first sign of dissent. SJCBCC lost in federal court over those proclivities.

In 2004, SJC’s First Amendment violations -- in the form of illegal abuse of its zoning “police power” to halt critical political billboards with unconstitutional SJCBCC Ordinance 99-51 --- were “struck down” as “unconstitutional on its face” by the U.S. 11th Circuit Court of Appeals in Atlanta. A three-judge appeals panel found that SJCBCC gave County Administrator Ben W. Adams, Jr. the “unbridled discretion” to censor political free speech, with an illegal “prior restraint” adopted in response to political billboards posted by the owner of by Cafe Erotica/We Dare to Bare. SJCBCC attempted to inflict “content restrictions” on free speech and to limit political signs to 32 square feet while allowing commercial signs as large as 560 square feet. SJCBCCC responded to signs that criticized county regulators, including signs that stated: “Karen Bruner is an Incompetent County Official” and “James Acosta is a fatass Barney Fife. He has cost the county thousands of $ in lost lawsuits for using selective [e]nforcements.” “Prior restraint” on free speech is illegal in America, even in the Pentagon Papers case (involving classified Vietnam War history excerpts that were published by the New York Times and other newspapers).

"Unyielding Commitment"
In 2003, ASHLAND CEO James J. O'Brien was paid $2,703,959 in total compensation including stock options, with another $623,227 in unexercised stock options from prior years.

ASHLAND, traded on the New York Stock Exchange as ASH, describes itself as having:
sales and operations throughout the United States and in more than 120 countries... including four wholly owned divisions: ASHLAND Paving And Construction (APAC®), ASHLAND Distribution, ASHLAND Specialty Chemical and Valvoline. In addition, we own 38 percent of Marathon ASHLAND Petroleum LLC, the nation's fifth largest refiner and marketer of petroleum products [which supplies Pilot and Speedway]. We've come a long way since we started in 1924 as a regional petroleum refiner. Despite our growth, and thanks to our vision, we have a strong sense of who we are, and an unyielding commitment to how we want to practice business.

"Corporate Bullies"
Multinational Monitor reported in 1994 that ASHLAND pressured the magazine Chemical and Engineering News to halt a story about its pollution on the West Virginia-Kentucky border. Diane Bady, director of the Ohio Valley Environmental Coalition, says that she worked with [reporter] Lepkowski for over a year on the story. "ASHLAND managers are corporate bullies," Bady says. "They fight behind the scenes to make it impossible for reporters and regulators to do their jobs."

As of April 1, Morris Communications' St. Augustine Record, the FOLIO Weekly and monopolistic Gannett's FIRST COAST NEWS ABC/NBC TV joint news affiliate operation all had never printed or uttered the name "ASHLAND" -- each only calling the plant's owner by its alias ("APAC," no "®"). None of these three media corporations responded to questions about why they have never reported the name ASHLAND (or ASHLAND's criminal history).

Meanwhile, one national "journalist" has served for seven years on convicted felon ASHLAND's Board of Directors.

U.S. News & World Report Publisher: "We Love Dr. Healy"
Since 1998, Dr. Bernadine P. Healy, M.D. has served on ASHLAND's Board of Directors, chairing its Environment, Safety and Health Committee and serving on its Audit Committee. Dr. Healy serves on President Bush's Council of Advisors on Science and Technology (CAST)(which did not respond to information requests).

Dr. Healy is "health columnist" for U.S. News and World Report, whose Publisher Mortimer Zuckerman is a multimillionaire real estate developer. Zuckerman told me February 1 (through his prefers-to-be-anonymous-spokesperson): "We have the greatest of confidence in Dr. Bernadine Healy. We love her. She is an extraordinarily talented physician and journalist." Zuckerman signs editorials with evocative titles like "The Politics of Cynicism" and publishes articles like "Two Cheers for Toxic Chemicals" -- advancing the "hormesis" theory that low levels of radiation and poisons are good for you.

On March 7, Healy told me that any questions about ASHLAND's SJC plant must "be dealt with by the company directly." Dr. Healy was asked if she cared to comment on conflicts-of-interest as a "journalist" ands corporate director-- she responded, "no not really -- thank you for calling, bye-bye," disconnecting.

Healy's February 14, 2005 U.S. News column says cancer is "sneaky and inexplicably virulent in many of its forms," hinting "a slew of chemicals at home and work" cause cancer (along with STDs, alcohol and chemicals released in cooking) -- cancer risks are hard to avoid "short of getting to a sackcloth and ashes nunnery. (Oops. Forget that. Ashes are on the list too.)" "Oops" indeed.

Identifying herself as a lifelong Republican and "feminist," Healy serves as a member of the boards of Hudson Institute (the late Herman Kahn's think tank), Marshall Institute (corporate-oriented science group), Battelle Memorial Institute (military and nuclear weapons contractor), National City Bank, Progressive Insurance, Invacare (maker of recalled, allegedly defective wheelchairs and other home medical equipment), Medtronics (manufacturer of silicon implants, recalled, allegedly defective heart and other medical devices, accused of giving monetary inducements to surgeons)(the U.S. Supreme Court denied its claims of "federal preemption" of tort claims).

Dr. Healy was formerly American Red Cross CEO ($400,000 per year, twice the salary of Elizabeth Dole in that job), Cleveland Clinic Research Director, Ohio State University Medical School Dean and head of coronary care unit at Johns Hopkins Hospital, with expertise in both medicine and pathology. In the 1980s. She was President Reagan's Deputy Director (Life Sciences) of the Office of Science and Technology Policy and the first President Bush's National Institutes of Health (NIH) Director, where she approved hundreds of patent applications for human genes and targeted the NIH Office of Scientific Integrity (OSI) for charges of privacy violations and conflict of interest. She has been a CBS News Medical Contributor.

On July 16, 1998, Healy told CNN's Larry King, "First and foremost a doctor has to relate and respond and care about the patient." The physician's Hippocratic Oath says, "First, do no harm." Does Dr. Healy believe her good buddies at ASHLAND followed that principle in placing an asphalt plant next to an elementary school and senior citizens?

Pollution Partners: One-Party Rule and Environmental Depredations
The late Senator Robert F. Kennedy said at Berkeley in 1967, "it is not enough to allow dissent, we must demand it, for there is much to dissent from," listing environmental and other societal problems that flow from abuses of power. Five all-Republican Commissioners, led by Commissioner Karen Stern, prayed at the January 26 SJCBCC meeting, asking they be spared from "dissension." Undemocratic blasphemy? If there had been more dissent, the ASHLAND plant might never have been allowed in a residential neighborhood.

John D. Rockefeller's and Henry Flagler's lawbreaking Standard Oil Trust was said to have done "everything" to the Pennsylvania legislature "except refine it." Corruption and environmental pollution have often been linked, from America to the developing world. By disconnecting people from policymaking, "corruption can have a devastating effect upon the environment" reports anti-corruption group Transparency, International.

Convicted felon ASHLAND, St. Johns County officials, and so-called journalists all have a lot of explaining to do:

Why locate an asphalt plant in a residential community?


Why weren't air pollutants ever measured?


Why can't more state and local governments operate their own cleaner asphalt plants?


How much asphalt will be produced to feed massive SJC overdevelopment?


Why didn't SJC enforce environmental provisions in its old paving contract?


How many "journalists" serve on corporate boards?


How many asphalt plants are causing health hazards for how many people worldwide?


Why are governments doing business with a known convicted felon?


Why isn't there an elected County Attorney (as elsewhere)?


Why isn't there an independent County Inspector General (as in Miami-Dade County and elsewhere)?


Is there any favor governments will not grant Big Business?


Will elected officials ever stop slow dancing with contractor-polluter-contributors like ASHLAND?
Will someone please explain it to us (no cherry-flavoring required) as if we were six-year olds? Will it take public protest for ASHLAND, the County and the Record to behave responsibly?
