The case involved false allegations by Sheriff DAVID SHOAR that the couple were operating an "industrial grow house" producing enough marijuana to "get an entire middle school high for an entire summer." SHOAR's henchmen weighed the dirt and claimed there was 40 pounds of pot. They pled to possession with intent to distribute 20 grams or more (less than an ounce), a felony and to one misdemeanor, possession of paraphernalia.
Judge Traynor ordered and the State's Attorney agreed that the Yandells have a right to use medical marijuana outside Florida and the State of Oregon has already accepted their probation.
The couple have prescriptions for medical marijuana. The lawyers who sold the Yandells the purported license they relied on continue doing so after the State investigated and the Florida Bar cleared them: Health Law Services and Florida Integrative Health and Ian Christiansen.
The State of Florida's flimsiest of cases was in flames, leading to today's plea agreement.
There is $15,000 investigation fee and $460 in court costs and an agreement to withdraw their public records requests to Sheriff DAVID SHOAR and State's Attorney RALPH JOSEPH LARIZZA.
Sheriff SHOAR's credibility is in shreds and his reputation as a pathological liar is reinforced.
LARIZZA obtains another bogus "conviction" statistic.
And "We, the People" see right through the tawdry Sheriff and tainted State's Attorney.
