HCN Article On "Polling" Sunshine Violations

There's an article on HCN about illegal "polling" in violation of our Sunshine laws, here.

Polling" violations of our Sunshine laws are all too common and illegal here, often done by government attorneys or managers. I objected to a request by St. Augustine Commissioners to share their input on an RFP with the City Manager, who was take their suggestions through polling and finalize the RFP, without a public meeting.

City Manager WILLIAM BARRY HARRISS frequently engaged in polling, admitting the practice to the St. Augustine Record in 2008 in haec verba -- informing Commissioners of sewage pollution of our saltwater marsh from a leaky "pipe" that was no longer a "pipe" so much as a collander. Commissioners okayed his doing nothing to replace the "pipe."

Then-Assistant City Manager JOHN PATRICK REGAN, P.E. (City Manager since 2010), with "pipe" whose sewage effluent pollution was covered up by polling by City Manager WILLIAM BARRY HARRISS, REGAN's self-confessed "mentor."

(Examining serial reconnaissance photos on the county's website in 2008, Ms. Judith Seraphin and I discovered a dark line in the City's saltwater marsh, pointing the way to uncovering the sewage effluent pollution. The replacement pipe was estimated to cost $1 million, but under scrutiny it cost less than that.(
