Polling" violations of our Sunshine laws are all too common and illegal here, often done by government attorneys or managers. I objected to a request by St. Augustine Commissioners to share their input on an RFP with the City Manager, who was take their suggestions through polling and finalize the RFP, without a public meeting.
City Manager WILLIAM BARRY HARRISS frequently engaged in polling, admitting the practice to the St. Augustine Record in 2008 in haec verba -- informing Commissioners of sewage pollution of our saltwater marsh from a leaky "pipe" that was no longer a "pipe" so much as a collander. Then-Assistant City Manager JOHN PATRICK REGAN, P.E. (City Manager since 2010), with "pipe" whose sewage effluent pollution was covered up by polling by City Manager WILLIAM BARRY HARRISS, REGAN's self-confessed "mentor."
(Examining serial reconnaissance photos on the county's website in 2008, Ms. Judith Seraphin and I discovered a dark line in the City's saltwater marsh, pointing the way to uncovering the sewage effluent pollution. The replacement pipe was estimated to cost $1 million, but under scrutiny it cost less than that.(
